अलीकडेच अन्न आणि औषध प्रशासनाने मॅकडोनाल्ड या आंतरराष्ट्रीय ब्रँड असलेल्या कंपनीच्या अहमदनगर येथील आउटलेट मध्ये चीज ऐवजी चीज सदृश्य(ऍनालॉग) पदार्थ वापरून ग्राहकांची फसवणूक केल्याचे कारण दाखवून त्यांच्याविरुद्ध कारवाई केल्याचे वृत्त प्रसिद्ध झाले आहे. या वृत्तामुळे जनसामान्यात अनेक तर्कवितर्क केले जात असून मॅकडोनाल्ड विक्री करीत असलेल्या त्यांच्या बर्गर आणि नगेट मध्ये वापरले जत होत ते चीज सदृश्य(ऍनालॉग) पदार्थ शरीराला अपायकारक आहे की काय येथपासून ते या कारवाईमागे इतर काही काळेबेरे तर नाही ना अशा शंका घेतल्या जात आहेत.

एक महत्त्वाची बाब म्हणजे मॅकडोनाल्ड कंपनी हा जागतिक ब्रँड असल्याने ती कंपनी चुका करणारच नाही हा गैरसमज काढून टाकला पाहिजे, कारण अशा व्यावसायिकांचे मुख्य लक्ष हे नफा कमवण्याकडे असते आणि तसे करताना आरोग्याची काळजी घेतीलच जातच असेल असा विश्वास ठेवणे गैरवाजवी ठरेल. इतर व्यवसायाप्रमाणेच अन्न व्यवसाय देखील एक अर्थार्जनाचे मोठे साधन असून कच्चामाल निर्मिती ते अन्नाचे प्रक्रिया उद्योग, रेडीमेड अन्न, खाद्यगृहे, अन्नाची आयात-निर्यात इत्यादींची वार्षिक उलाढाल ही सुमारे तीन दहा ट्रिलियन डॉलर्स म्हणजेच भारतीय अर्थव्यवस्थेच्या जवळ जवळ तिप्पट इतकी प्रचंड मोठी आहे आणि ती दरवर्षी वाढतच आहे. यामध्ये सर्वात मोठी वाढ ही रेडिमेड अन्न आणि खाद्यगृहे यामध्ये दिसून येते. त्यामुळे या व्यावसायिक अन्नाची गुणवत्ता चांगली असावी व ग्राहकांची फसवणूक होऊ नये म्हणून सर्व देशात कायदे तयार करण्यात आले असून भारतात सुद्धा अन्नसुरक्षा व मानके कायदा, २००६ हा अत्यंत प्रभावी कायदा २०११ पासून लागू करण्यात आलेला आहे. अन्नाची गुणवत्ता राखली जावी व ग्राहकांची फसवणूक होऊ नये म्हणून केंद्र शासनाच्या भारतीय अन्नसुरक्षा व मानक प्राधिकरण आणि प्रत्येक राज्यात अन्नसुरक्षा आयुक्त व त्यांची सर्वदूर पसरलेली यंत्रणा नियुक्त झालेली असते. त्यांचे काम म्हणजे ग्राहकांना गुणवत्तापूर्णक अन्न मिळावे व त्याबाबत जे गैरप्रकार होतात त्यांच्याविरुद्ध प्रखर कारवाई करून अन्नामध्ये कोणतेही चुकीचे प्रकार करण्यास कोणीही धजवणार नाहीत याबाबत काळजी घेणे.

मॅकडोनाल्ड कंपनीविरुद्ध जी कारवाई झाली आहे ती ही कंपनी भेसळयुक्त पदार्थांची विक्री करीत होती म्हणून नव्हे तर ती कंपनी ग्राहकांची दिशाभूल करीत होती म्हणून झालेली आहे. कायद्यात एक तत्त्व दिले आहे की अन्न व्यावसायीकांना कायद्याच्या कक्षेत राहून ते त्यांचे अन्न पदार्थ काय असावेत ते ठरवू शकतात, त्यांचे ब्रँडिंग करू शकतात फक्त ऐट ही आहे की ते जे पदार्थ आहेत त्याची खरीखुरी माहिती त्यांनी ग्राहकांना देणे अनिवार्य आहे. अन्नाची विक्री करतांना वेष्टने, माहिती-पत्रक(मेन्यू), लेबल्स, नावे, जाहिरातीत किंवा अन्य कोणत्याही मार्गाने उपलब्ध केली जाणारी माहिती सत्यच असावी. त्याचबरोबर त्यांची खरी माहिती द्यावीअन्न पदार्थांचे वजन, ते किती कालावधीपर्यंतच सेवनास योग्य, त्यामधून किती कर्ब, प्रथिने, स्निग्न पदार्थ इत्यादी उपलब्ध होतील व किती उष्मांक त्याच्यामध्ये सामावलेले आहेत त्याप्रमाणे बहुतेक अन्नपदार्थांची गुणवत्ता काय असावी हे नियमान्वये ठरवून दिलेले आहे. नियमनाद्वारे बहुतेक अन्न पदार्थांचे मानकेविहित केली असून ते पदार्थ त्याप्रमाणे नसतील तर आस्थापना निलंबित करणे, लायसन्स रद्द करणे, दंड आकारने, कैदेची शिक्षा इ सारख्या कारवाया प्रशासन या आस्थापनाविरुद्ध करू शकतात.

मॅकडोनाल्ड च्या बाबतीत त्यांच्या चीज बर्गर आणि चीज नगेट मध्ये चीज देणे नियमांनुसार बंधनकारक होते कारण पदार्थांच्या नावामध्येच “चीज” नमूद होते. सदर चीज सुद्धा नियमात नमूद केल्याप्रमाणे दूधापासूनच बनविलेले आणि ते देखील ठराविक आर्द्रता व स्निग्धता (सर्वसाधारणपणे अनुक्रमे ३९% आणि ४८%) असणे आवश्यक होते. तथापि ते चीज ऐवजी चीज सदृश्य पदार्थांचा(चीज ऍनालॉग) वापर करीत होते. हे चीज सदृश्यपदार्थ पारंपारिक चीज नसून प्रक्रिया केलेले आणि ते नैसर्गिक दुधाऐवजी वनस्पती तेल, प्रथिने, अन्य पदार्थ इ पासून बनविलेला असा चीज सदृश पदार्थ की ज्याची चव पारंपरिकची चीज सारखी असेल. म्हणजेच या ऍनालॉग चीज ची चव आणि गुणधर्म अशा पद्धतीने तयार केले जातात की ग्राहकांना ते पारंपरिक चीज नाही याची कल्पना सुद्धा येत नाही.

अर्थात हे ऍनालॉग किंवा सदृश्यपदार्थ का वापरले जातात हे समजून घेणे आवश्यक राहिल. एक तर पदार्थांची निर्मिती खर्च कमी करणे किंवा उष्मांक कमी करून तो जास्त आरोग्यवर्धक करणे किंवा ज्यांना प्राण्यापासून निर्मित पदार्थ चालत नाहीत त्यांच्यासाठी वनस्पती पासून पदार्थांचा पर्याय देणे किंवा पारंपारिक पदार्थामुळे एलर्जी होत असेल तर त्यास पर्याय देणे हे होय. असे ऍनालॉग पदार्थ हे जगभर वापरले जातात आणि त्यासाठी कायद्यामध्ये नियम केलेले आहेत आणि तसे नियम भारतात सुद्धा आहेत. म्हणजेच ऍनालॉग अन्नपदार्थ हे त्याज्य नाहीत किंवा अपायकारक नाहीत आणि म्हणून त्यांना परवानगी देण्यात आलेली असते. मॅकडॉनल्डच्या बाबतीत बर्गर किंवा नगेट मध्ये ऍनालॉग पदार्थ आहेत हे नमूद केले नव्हते व ते पदार्थ वनस्पती तेल, प्रथिने वगैरे पासून तयार केलेले होते ही वस्तुस्थिती ग्राहकापासून लपवून ठेवून त्यांची फसवणूक केली होती असे प्रकरण होते.

बाजारात जगभर अशा ऍनालॉग पदार्थांचे अनेक प्रकार प्रचलित असून त्यांची विक्री केली जाते. त्याबाबतची काही उदाहरणादाखल नमूद करण्यासारखे ऍनालॉग म्हणजे साखरे ऐवजी सॅकॅरिन,आस्पर्टेम, स्टीविया; दुग्धजन्य पदार्थांचे वनस्पती तूप, सोयाबीन वगैरे पासून तयार केलेले ऍनालॉग, सोयाबीनपासून तयार केलेले दूध, भुर्जी, खिमा अशा प्रकारचे मांसारासारखे पदार्थ बाजारात उपलब्ध आहेत. हे ऍनालॉग पदार्थ आता सर्रास उपलब्ध असल्याने ते आरोग्यास अपायकारक असू नयेत , शिवाय त्यांचा दर्जा चांगला राहावा म्हणून केंद्र शासनाच्या भारतीय अन्नसुरक्षा व मानक प्राधिकरणाने नियमन केलेले आहेत. प्रश्न फक्त हा राहतो की अन्न आस्थापनांनी त्याबाबत ग्राहकांना वस्तुस्थिती स्पष्ट केली पाहिजे. प्रशासनाची कारवाई स्तुत्य असली तरी ती काही मूलभूत प्रश्न निर्माण करते या प्रशासनाची अन्न व औषध प्रशासनाची वैधानिक जबाबदारी ही जनतेला गुणवत्तापूर्ण आणि कोणतीही फसवणूक न होता अन्न पदार्थ उपलब्ध होतील अशी आहे. विशेषत: हे अन्न पदार्थ ग्राहकांपर्यंत पोहोचण्यापूर्वीच ते कायद्याप्रमाणे तयार झालेले आहेत किंवा नाहीत आणि नसल्यास ते ग्राहकापर्यंत पोहोचून त्यांचे आरोग्य धोक्यात येण्यापूर्वीच प्रशासाने कारवाया केल्या पाहिजेत असा कायदा आहे. मॅकडॉनल्डच्या बाबतीत ही कारवाई म्हणवी वरातीमागून घोडे अशा स्वरूपाची असून अन्न आणि औषध प्रशासन हे त्याबाबतीत अपयशी ठरलेले आहे व त्यास जे अधिकारी जबाबदार आहेत त्यांच्याविरुद्ध कारवाई होत नाहीत तोपर्यंत असे प्रकार राज्यात घडत राहतील. राज्य शासन देखील अन्न आणि औषध प्रशासन हे त्यांचे काम योग्य पार पाडीत आहे किंवा नाही ह्याचा आढावा घेवून वचक ठेवण्यात कमी पडत असेल तर शासन सुद्धा या गैरप्रकारास तितकेच जबाबदार होय.

या कारवाया तोंडदेखल्या अहेत की वैचारिकृत्या केलेल्या आहेत हा आणखी एक गहन विषय. वास्तविकत:, ज्या अन्नपदार्थांचे सर्वात जास्त सेवन केले जाते त्या अन्नपदार्थांची गणवत्तेबाबत राखणे आणि त्यात भेसळी होवू नये म्हणून दक्ष राहणे या बाबील प्राथमिकता प्रशासनाने देणे ही त्यांची आद्य जबाबदारी. त्यातही, आरोग्यास आणि जीवितास घातक पदार्थ अन्नामधून ग्राहकांवर थोपविले जात नाहीत यावर दैनंदिन काळजी घेतली गेली पाहिजे. उदाहरणार्थ , राज्यात ज्या दुधाचे सेवन तान्हया बाळापासून आबालवृद्धांपर्यंत दररोज १४ कोटी जनता करते ते दूध नैसर्गिक असल्याचा आणि ते अपायकारक रसायनापासून तयार करून भयानक व्याधी निर्माण करणारे तर नाही ना यावर किती कारवाया केल्या हे महत्त्वाचे. राज्यामध्ये रासायनिक दूध असते हे ही बाब दुर्लक्षित करून चालणार नाही. अशा दुधामुळे लिव्हर, हृदय, किडनी, मेंदू इ अवयावर भयानक परिणाम होऊ शकतात किंवा कर्करोग सुद्धा होऊ शकतो, त्यामुळे दुग्ध उत्पादक यांच्याकडून किती दूध संकलित केले आणि तितकेच दूध विक्री होते लक्ष ठेवण्यासाठी वर्षातून दोन वेळेस मोठ्या दूध उत्पादकांना विवरणपत्र अन्न व औषध प्रशासनाकडे दाखल करण्याचे नियमाने बंधन केलेले आहे. असे विवरण पत्र दाखल केले जाते किंवा नाही व दाखल केले असल्यास त्यामध्ये काही काळेबेरे दिसून आले किंवा कसे याबाबत अन्न व प्रशासनाकडून काय कारवाई होते हे सर्वसामान्यांना देखील समजणे गरजेचे आहे. अन्यथा यामधून अवैधपणे पैसा मिळवणे ही गुन्हेगारी स्वरूपाची बाब आहेच शिवाय रासायनिक दूध खपवून महाभयानक प्रकार जनतेच्या आरोग्यावर थोपवणे म्हणजे हे दुहेरी गुन्हेगारीचे प्रकार थांबण्यासाठी या प्रशासन काय कारवाई केली हे नागरिकांना माहित होत नाही. त्यामुळे केवळ मॅकडोनाल्ड सारख्या काही मूठभर ग्राहकांच्या संबंधित केलेल्या कारवाईने आपली पाठथोपटून घेण्यासाठी दार्शनिक केलेली कार्यवाही स्तुत्य असली तरी दुधाच्या समस्येवर काय कारवाई केली हे दिसून येत नाही. असेच प्रकार तेलामधील भेसळ, पिठामधील भेसळ या दैनंदिन स्वरूपाच्या अन्नपदार्थातील भेसळीमुळे आरोग्यावर विधातक परिणाम होतात व त्यावर अन्न व औषध प्रशासन काय करते हे याबाबत जनता अनभिज्ञ असते.एक महत्वाची बाब अशी आहे की जसा जसा काळ पुढे जात आहे तसे तसे प्रक्रिया केलेले अन्न वाढीस लागले असून या प्रक्रिया केलेल्या अन्नाचा दुष्परिणाम आरोग्यावर होणार नाही याची काळजी प्रशासनाने घेतली पाहिजे. त्याची सुरुवात अन्नाच्या जाहिराती पासून होते. कायद्यामध्ये अन्नपदार्थांची जाहिरात अशा पद्धतीने करू नये की ज्यामधून त्या अन्नामुळे काय होऊ शकते हे सर्वसामान्यांच्या मनावर चुकीच्या पद्धतीने बिंबवण्यात येऊ नये, तर केवळ जाहिरातीमध्ये हे अन्नपदार्थांमध्ये काय तत्त्व आहेत केवळ तेच देणे मान्यताप्राप्त आहे. अलीकडे अनेक जाहिरातीमध्ये विशेषता तेल, लहान मुलांसाठीची पेये इ स्वरूपाच्या पदार्थांच्या बाबतीत ते पदार्थ किती चांगले परिणाम करतात अशा स्वरूपाच्या जाहिराती मोठ्या प्रमाणात टीव्ही चॅनल आणि वृत्तपत्रांमध्ये असतात. अशा चुकीच्या जाहिराती वर सुद्धा कारवाई अन्न व औषध प्रशासनाने करणे अपेक्षित असते पण तशी कारवाई होताना दिसत नाही. एकंदरीतच मॅकडॉनल्ड वरी झालेली कारवाई स्तुत्य असली तरी राज्यातिल जनतेला निर्भेळ आणि कोणतीही फसवणूक होता अन्नपदार्थ मिळतात किंवा नाही याकडे अन्न व औषध प्रशासनाने लक्ष देणे गरजेचे आहे.

The Transparency International, a distinguished NGO headquartered in Berlin, Germany, founded three decades ago and operational globally in the realm of corruption, has recently published the 2023 “Corruption Perception Index” for 180 nations, as is customary each year. This index is meticulously computed to assign zero points to the most corrupt country, with a pinnacle of 100 points reserved for the paragon of probity. Subsequently, the nations are arranged in a descending order from the most scrupulous to the most tainted. In this hierarchical array, Denmark has ascended to the zenith as the most virtuous nation globally, securing an impressive 90 points. Trailing closely behind are Finland, New Zealand, Norway, Singapore, Sweden, and Switzerland. Conversely, Somalia has earned the ignominious distinction of being the foremost purveyor of corruption on a global scale, registering a mere 11 points. Venezuela, Syria, and South Sudan find themselves ensnared in the same web of corruption with a score of 13 points. India, unfortunately, languishes at a lowly 93rd position in the roster of virtuous nations, amassing a modest 39 points. Alas, the data gleaned from this investigation suggests a disconcerting truth – India, having descended eight places from its 2022 standing, is grappling with an unabating surge in corruption.

Corruption, an affliction experienced daily by the citizens of India, assumes a more disquieting dimension when subjected to the scrutiny of an international organization. This is particularly distressing for a country boasting the world’s oldest culture and the grandeur of being the largest democracy. Elucidating the nature of corruption is unnecessary, as readers can draw upon personal experiences or observe the prevailing circumstances. The question that begs consideration is why a nation rooted in ancient principles of truth, honesty, and spirituality finds itself mired in the morass of corruption. Who bears the culpability for this lamentable state of affairs? Even if the eradication of corruption proves elusive, why cannot a culture of integrity akin to that of Denmark, Finland, New Zealand, and Norway be instilled?

Corruption, a multifaceted malady, finds its genesis in the various facets of human morality. Immorality, a pernicious element in human nature, serves as the bedrock of corruption.

While Transparency International’s index encompasses diverse aspects of corruption, its primary focus is on financial malfeasance, particularly within the ambit of government administration. The private sector is not exempt from this blight, but its roots can be traced back to governmental corruption. A discourse on corruption, against the backdrop of this index, warrants attention.

At the global level, the United Nations (UNO) has deemed corruption a “pernicious plague,” recognizing it as an imminent threat to society and democracy. Consequently, member nations are enjoined to formulate policies, enact laws, and establish judicial systems to thwart corruption, punish transgressors, and extirpate this malevolent influence. In the Indian context, the Prevention of Corruption Act of 1988, applicable to all public servants, encompasses government entities, the judiciary, public representatives, statutory public undertakings, co-operative society officers, and government companies. This legislation categorizes the acceptance of illicit remuneration by public servants as corruption, prescribing exhaustive measures for investigating and penalizing the guilty. Each state maintains an Anti-Corruption Bureau(ACB) and at the central government level, the Vigilance Commission, Central Bureau of Investigation (CBI), and special courts have been instituted. Independent bodies like Lokayukta and Lokpal serve as additional bulwarks against corruption. Despite these legal provisions, India’s descent in global rankings is perplexing, a trend corroborated by the 2023 report from the National Crime Records Bureau, revealing a 10.5 percent surge in corruption cases in 2022.

Corruption, an entrenched social malaise, is attributable to myriad factors, including governance, administration, investigative mechanisms, judicial processes, societal apathy, electoral processes, and legal anomalies. The epicenter of corruption lies in the electoral process, where escalating campaign costs engender a symbiotic relationship between politicians and vested interests. Joseph Stiglitz, a Nobel laureate in Economics, posits that contemporary democracy has devolved into a system democracy is no more a system “of the people, by the people and for the people”, but it has become a “system of the one percent, by the one percent and for the one percent”, the one percent being super rich people who have captured democracy as their slave. And , therefore, curtailing spending in elections emerges as a pivotal step toward ameliorating corruption in the country.

Identifying the principal contributor to corruption within the country prompts contemplation on whether it emanates from the administration or the bureaucracy. In a democratic system, periodic elections underscore the impermanence of elected representatives, necessitating a system of checks and balances between them and the bureaucracy. Constitutional safeguards, encapsulated in Part 14, forestall bureaucratic malfeasance and foster a harmonious coexistence with elected officials. The bureaucracy, empowered by its constitutional mandate, bears a solemn responsibility to combat corruption.

Corruption within the administrative echelons operates on two planes: personal corruption and collusion in others’ malfeasance within the government system. The former encompasses illicit financial gains for expediting assigned tasks (speed money), engaging in unlawful activities, or accepting remuneration to overlook ongoing transgressions (bribes). Standing at the lectern, I found myself at the nexus of opportunity and responsibility, entrusted with the task of illuminating pathways to economic empowerment for these young souls. The canvas before me was painted with tales of resilience, starkly contrasting the narrative of development that had brushed past them for the last seven decades. This was not merely a lecture but a shared journey towards understanding the aspirations and challenges of those who reside in the shadows of progress.

The glow of satisfaction on their faces, a response to the revelation of local business opportunities and prospects in government jobs reserved for tribals, was palpable. स्थानिक स्वराज्य संस्थांच्या निवडणुका या पाच वर्षांनी झाल्याच पाहीजे हे संविधानातच आहे. घटनेतच तशी तरतूद असेल तर या निवडणुकांना सर्वोच्च न्यायालय असो किंवा अन्य कोणी त्याला स्थगिती देऊ शकते का ? जोपर्यंत घटना दुरूस्ती होत नाही, तोपर्यंत राज्यांचे जे निवडणूक आयुक्त आहेत, त्यांनी या निवडणुका घेणे बंधनकारकच आहे. पण गेली तीन वर्षे जर निवडणुका घेतल्या नसतील तर हा घटना आणि संविधानाचाही भंग आहे.

१९५० साली आपण लोकशाही व्यवस्था आणली. लोकशाही म्हणजे लोकांचे राज्य. लोकशाही म्हणजे प्रत्येक नागरीकाला शासनाच्या निर्णय प्रक्रियेत स्थान मिळणे . . लोकसंख्या प्रचंड वाढल्याने प्रत्येक नागरीकाला निर्णय प्रक्रियेत सहभागी होता येत नाही, म्हणून ते लोकप्रतिनिधी निवडून देण्याची लोकशाही व्यवस्था अस्तित्वात आली . देश, राज्य, आपले शहर किंवा गाव प्रशासन, विकास यासाठी लोकप्रतिनिधीमार्फत शासन चालवले जाते. अर्थात हे करताना सर्वात महत्त्वाचे म्हणजे त्यासाठी संविधान आले, कायदे आले, त्यातून राज्य व देश कसे चालवायचे हे ठरले. १९९३ पर्यंत स्थानिक स्वराज्य संस्थांसाठी संविधानामध्ये तरतुदी नव्हत्या. फक्त ग्रामपंचायती असाव्यात एवढीच तरतूद होती. संविधानामध्ये राज्य व केंद्र शासनाचा कार्यकाल किती, आमदार , खासदार किती, मतदार संघ कसे असावेत याबाबत तरतुदी होत्या पण तशा विस्तृत तरतुदी स्थानिक स्वराज्य संस्थासाठी नव्हत्या त्याच स्वरूपाच्या तरतुदी करण्यासाठी ७३ वी व ७४ वी घटना दुरूस्ती करण्यात आल्या. . स्थानिक प्रश्न, समस्या यांची जाण आणि ते सोडविण्यासाठी स्थानिक पातळीवर काय करावे लागेल हे स्थानिकांना जास्त अवगत असते हे गृहीत धरले गेले व त्या प्रमाणे तरतुदी केल्या गेल्या. प्रश्‍न सोडवण्यासाठी नागरीकांचा सहभाग महत्त्वाचा असल्याचे पुढे आले. केवळ दिल्ली, मुंबईत बसून गाव, शहर किंवा जिल्हा पातळीवरचे प्रश्‍न सोडवता येणार नाहीत. त्यामुळे जगभर जी स्थानिक पातळीवरील व्यवस्था आहे, तशीच व्यवस्था घटना दुरूस्तीतून पुढे आल्या. त्यातून स्थानिक स्वराज्य संस्थांची निर्मिती झाली. काही राज्यात ग्रामपंचायत, जिल्हा परिषदा पूर्वीही होत्या. याबाबत महाराष्ट्र राज्य अग्रेसर होते. तथापि याबाबतच्या कायद्यात काही त्रुटी होत्या. संपूर्ण देशात प्रत्येक गाव, शहर, जिल्हा इ साठी स्थानिक स्वराज्य संस्था निर्माण करण्याचे बंधन आले. त्यानुसार प्रत्येक राज्याला कायदे करावे लागले. प्रत्येक स्वराज्य संस्थेने काय करायला पाहिजे हे निश्‍चित झाले व त्याकरिता संविधानात त् अनुसुची ११ व १२ जोडण्यात आल्या. त्यात केंद्र व राज्य सरकारने काय काम करायचे याच धर्तीवर या सुचीनुसार स्थानिक स्वराज्य संस्थांचे काम निश्‍चित करण्यात आले.

याअनुषंगाने संविधानात बदल करतांना दोन-तीन तरतुदी अतिशय महत्त्वाच्या आहेत. एक तर ठराविक त्या भौगोलिक क्षेत्रासाठी भागानुसार एक लोकप्रतिनिधी निवडून देण्यासाठी मतदारसंघाची रचना, जेणेकरून तिथल्या नागरीकांचे जे प्रश्‍न असतील ते संबंधित लोकप्रतिनिधी त्यात स्थानिक स्वराज्य संस्थेत मांडेल. दुसरी तरतूद सुद्धा अतिशय महत्वाची असून ती म्हणजे या संस्थांचा कार्यकाल पाच वर्षाच अनिवार्य करण्यात आला.

पुर्वी महाराष्ट्रात स्थानिक स्वराज्य संस्था ही जरी व्यवस्था असली तरी बऱ्याचवेळी या संस्थांचे काम पाच वर्षापेक्षा जास्त काळ म्हणजे कधी कधीदहा, पंधरा वर्षे चालायचे व ते लोकशाहीच्या प्रणालीशी विसंगत होते. पाच वर्षांनी निवडणुका घेतल्याचं पाहिजेत असे संविधानात्मक बंधन नव्हते. आता स घटनेमध्ये त पाच वर्षांनी निवडणुका घेणे बंधनकारक करण्यात आले आहे आणि त्याकरिता तशा तरतुदी अनुच्छेद २४३-ई हे ग्रामीण तर २४३-यु हे शहरी भागासाठी तरतूद करण्यात आल्या आहेत. या तरतुदीअन्वये या स्थानिक संस्थांचा कार्यकाल पाच वर्षांचाच असेल असेल हे अनिवार्य झाले आहे. त्यात अर्थात स्थानिक स्वराज्य संस्था नव्याने निर्माण होणे , त्यांचे विभाजन होणे किंवा अन्य कोणत्याही कारणामुळे जर त्यांचा कार्यकाळ संपुष्ठात आणणे आवश्यक झाले तर काय करावे हा प्रश्न निर्माण होऊ शकतो व त्यावर तोडगा म्हणून देखील तरतुदी करण्यात आल्या आहेत. स्थानिक स्वराज्य संस्था बरखास्त झाली तर त्याठिकाणी सहा महिन्यात निवडणुका घेणे हे संविधानानुसार बंधनकारक आहे. यापेक्षा महत्त्वाची तरतूद अशी आहे, कि एखाद्या संस्थेचा पाच वर्षाचा कार्यकाल अमूक एका तारखेला संपत असेल तर तत्पुर्वी निवडणूक प्रक्रिया पूर्ण होऊन तिथे लोकप्रतिनिधी निवडून आले पाहीजेत! ही महत्त्वाची तरतूद आहे. म्हणजे कार्यकाल संपल्याच्या दुसऱ्या दिवशी नवे सभागृह येणे कायद्याने आवश्‍यक आहे. ही घटनात्मक तरतूद आहे. ही केवळ कायद्यातील तरतूद नसून संविधानात्मक तरतूद असल्याने जोपर्यंत घटना दुरुस्ती होत नाही तोपर्यंत , त्यात कोणी बदल करू शकत नाही.

कांही वर्षांपूर्वी नागरीकांचा मागास प्रवर्गासाठी जे राजकीय आरक्षण दिले होते, त्याबाबत एक कर्नाटक राज्याचा सर्वोच्च न्यायालयाचा निर्णय आला होता. त्यात नागरीकांचा मागास प्रवर्गासाठी राजकीय आरक्षण देण्यासाठी एक प्रक्रिया निर्देशित केली होती. पण बहुतेक राज्यांनी त्याकडे दुर्लक्ष केले. महाराष्ट्रात याबाबत एका अर्जदाराने सर्वोच्च न्यायालयाच्या निर्णयानुसार प्रक्रिया राबवण्याची मागणी केली. ओबीसींची लोकसंख्या किती, त्या प्रमाणात त्यांना आरक्षण द्यावे अशी ती मागणी होती. यात ओबींसींचे आरक्षण एकूण जागेच्या पन्नास टक्क्यापेक्षा जास्त जाऊ नये असाही एक मुद्दा होता. मग हे प्रकरण सर्वोच्च न्यायालयात गेले. काही संस्थांचा कार्यकाल संपल्याने सर्वोच्च न्यायालयाने महाराष्ट्रातील स्थानिक स्वराज्य संस्थाच्या निवडणुकांना स्थगिती दिली. मग हे दृष्टचक्र सुरू झाले. त्यात मग शासनाने एक आयोग नेमला. या आयोगाने सर्वोच्च न्यायालयाच्या म्हणण्यानुसार ओबींसींचे आरक्षण किती असावे ते सांगितले. हा अहवाल दिल्यानंतर सर्वोच्च न्यायालयाने ही स्थगिती उठवली. जुलै २०२२ मध्ये दिलेल्या या निर्णयाने निवडणुका घेण्याचा मार्ग मोकळा झाला.

या निर्णयालाही काहींनी आव्हान दिले. वॉर्ड रचना, आरक्षण यासारख्या अन्य कारणांमुळे हे प्रकरण लांबत गेले. ही स्थगिती आजतागाया तशीच चालू आहे.

स्थगिती उठविण्यासाठी राज्य शासनाच्या पातळीवर याचा पाठपुरावा झाला का नाही हे माहित नाही.

लोकशाहीमध्ये शासन म्हणजे लोकप्रतिनिधींनी तयार केलेली व्यवस्था म्हणजेच शासन आणि त्यात लोकप्रतिनिधींचे असणे हा मूळ गाभा आहे. . लोकशाहीमध्ये लोकप्रतिनिधी आणि प्रशासन हे एका रथाची दोन चाके असे म्हटले जाते पण खरे म्हणजे लोकप्रतिनिधींमधून तयार झालेली व्यवस्था हे वशासनकर्ते व त्याला सहाय्यभूत ही प्रशासकीय व्यवस्था असते. त्यामुळे लोकप्रतिनिधीविना व्यवस्था हि लोकशाहीला अभिप्रेत व्यवस्था नसून जितका काही काळ प्रशासक असतील तितका काळ लोकशाही ही संस्थगित झालेली आहे सत्य मान्यच करावे लागेल.

संविधानात प्रशासक फक्त सहा महिनेच असे असू शकते असे प्रावधान केले आहे. त्यामुळे सहामहिन्यापलिकडे जो काही कार्यकाल झाला आहे तो असंविधानिक आहे. लोकप्रतिनिधी आणि प्रशासकीय यंत्रणा हि एकमेकांना पूरक तसेच एकमेकांवर वचक ठेवणारी व्यवस्थाही असते. आता केवळ प्रशासक असल्याने तेच सर्वेसर्वा असतात आणि त्यांच्यावर असलेला लोकप्रतिनिधींचा वचक संपुष्ठात आल्याने तेच स्थायी समिती, सर्व समित्या, सर्वसाधारण सभा, आयुक्त अशी परिस्थिती असते. . त्यामुळे हे लोकशाही प्रक्रिया नसलेली संस्था तिथे चालू आहे. अर्थात त्यावर कायदा, शासन यांचे बंधन असते. शासन इतकी मोठी व्यवस्था आहे की शासन स्तरावर त्यांना स्थानिक संस्थांच्या दैनंदिन कामकाजात लक्ष घालणे शक्य नसते.

इंग्लंडचा लॉर्ड एक्टन नावांच्या एका विचारवंतांनुसार सत्ता हि भ्रष्टतेकडे झुकविते आणि अनिर्बंध सत्ता पूर्णपणे भ्रष्ट करू शकते. ( Power tends to corrupt, and absolute power corrupts absolutely. आपल्याकडे असे घडते का ते माहित नाही. काही अधिकारी चांगले काम करतही असतील. पण असे घडण्याची शक्यता नाकारता येत नाही. म्हणून लोकशाहीत एकमेकांवरील नियंत्रण महत्त्वाचे असते. लोकप्रतिनिधींचा वचक प्रशासनावर आणि प्रशासनाकडून चुकीच्या गोष्टी घडत असतील तर जनकल्याणासाठी त्यावर लोकप्रतिनिधींकडून नियंत्रण आणले गेले पाहीजे.हे सर्व जनतेच्या भल्यासाठी आवश्‍यक आहे. लोकप्रतिनिधींची अमर्याद सत्ता नको म्हणून तिथे प्रशासकीय व्यवस्था असते. पण प्रशासकीय व्यवस्था अमर्याद नको म्हणून तिथे लोकप्रतिनिधी गरजेचे असतात. यातील एक बाजू सध्या अस्तित्वातच नाही. प्रशासकीय यंत्रणेची मानसिकता ही बहुतांश वेळेस साचेबंद पध्दतीने काम करण्याची असते. पण लोकप्रतिनिधी हे राजकीय व्यवस्थेतून जे तळागाळातून नेतृत्त्व तयार होऊन येते, जे निवडणुकीतून पुढे येतात, त्यांना आपले गांव, शहर, राज्य, देश कसा असावा याची एक व्यापक भुमिका तयार असते. सर्वसाधारण असे दिसते या देशात जे काही भव्यदिव्य, चांगले, लोकोपयोगी, लोकाभिमुख घडले ते काही चांगल्या लोकप्रतिनिधींच्या प्रयत्नातून घडले आहे हे मनी करावे लागेल. हे सर्व प्रशासनावर सोडले असते तर कदाचित असे घडलेच असते असे नाही. अधिकारी हे त्यांच्या प्रशासकीय व्यवस्थेला जबाबदार असतात. त्याचप्रमाणे लोकप्रतिनिधी हे जिल्ह्याचे, राज्याचे, देशाच्या नेत्यांच्या व्यवस्थेला जबाबदार असतात. त्यांच्या संपर्काचा, राजकीय संबंधांचा फायदा त्या गावाला शहराला होतो. यामधून सर्वांगीण विकासासाठी विविध बाबतीत मग ते निधी मिळवणे असो, प्रकल्प आणणे, पायाभूत सुविधा तयार करायच्या असतील यासाठी लोकप्रतिनिधींचा जो रेटा असता तितका रेटा प्रशासकीय अधिकारी करू शकेलच असे नाही.

घटनेमध्ये केंद्र, राज्य शासन व स्थानिक स्वराज्य संस्थेच्या बाबतीत व्यवस्था म्हणून समान संविधानिक तरतुदी आहेत. मग केवळ स्थानिक स्वराज्य संस्थांच्या पातळीवरच प्रशासक व्यवस्था सापत्न वाटत नाही का ?केंद्राच्या पातळीवर कॅबिनेट सचिव किंवा राज्यात मुख्य सचिव प्रशासक म्हणून तीन वर्षे ठेवणे योग्य होईल का ? अर्थातच याचे उत्तर नाही असे आहे. मग स्थानिक पातळीवरच प्रशासक का ? हा प्रश्‍न जनतेला का पडू नये. माझे निरीक्षण असे आहे की, नागरीकांना हा विषय राजकीय काही तरी आहे, आपल्याशी काही संबंध नाही असे वाटते. त्यामुळे छोट्या- छोट्या गोष्टीसाठी आवाज उठवणारे नागरीक स्थानिक पातळीवरील लोकशाही हिरावून घेतली गेली याबाबत ते कमालीचे निरूत्साही आहेत. हा लोकशाहीबाबतचा निरूत्साह चालूच राहीला तर काळ सोकावेल.

‘वन नेशन, वन इलेक्शन’

(‘एक देश-एक निवडणूक’)

लोकसभेच्या आणि विविध राज्यांच्या विधानसभांच्या निवडणुका वेगवेगळ्या वेळी होतात, त्याऐवजी या सर्व निवडणुका एकाच वेळी व्हाव्यात म्हणजेच ‘एक देश-एक निवडणूक’ ही संकल्पना वास्तवात आणावी अशी चर्चा देशात वारंवार होत असते. अगदी अलीकडेच म्हणजे १ सप्टेंबर २०२३ रोजी केंद्रीय संसदीय कामकाज मंत्री श्री प्रल्हाद जोशी यांनी “एक देश-एक निवडणूक’ या संकल्पनेबाबत विचार विमर्श करण्यासाठी माजी राष्ट्रपती श्री राम नाथ कोविंद यांच्या अध्यक्षतेखाली एक समिती नेमल्याचे जाहीर केले. या समितीने तातडीने अहवाल द्यावा असे सुचित करण्यात आले आहे.

‘एक देश-एक निवडणूक’ ही संकल्पना तशी काही नवीन नाही. याबाबत भारतीय जनता पार्टी या पक्षाने आणि पंतप्रधान श्री नरेंद्र मोदी यांनी २०१४ नंतर वारंवार त्याचे सूतोवाच केलेले आहे. विशेषतः पंतप्रधानांनी त्यांच्या २०१९ च्या स्वातंत्र्य दिनाच्या भाषणात असे मत व्यक्त केले की जीएसटीच्या रूपात एक ‘देश एक करप्रणाली’ यशस्वीरित्या लागू झाल्यानंतर आता ‘एक देश-एक निवडणूक’ ही मागणी जोर धरीत आहे. तसेच त्यांनी मध्ये पुन्हा सत्तेत आल्यानंतर विविध राजकीय पक्षांच्या बैठकीत असे मत व्यक्त केले होते की आता देशात एकत्रित निवडणूक घेण्याबाबत विचार होणे गरजेचे आहे. त्याचबरोबर पंतप्रधानांनी नोव्हेंबर २०२० मध्ये पिठासीन अधिकाऱ्यांच्या बैठकीत सुद्धा मुद्दा मांडला की ‘एक देश-एक निवडणूक’ हा केवळ चर्चेचा विषय नसून ती देशाची गरज आहे. या व्यतिरिक्त विधी आयोगाने त्यांच्या ऑगस्ट, २०१८ मध्ये सादर केलेल्या प्रारूप अहवालात एकत्रित निवडणुकांबाबत सूतोवाच केलेले होते. त्यापूर्वीदेखील न्यायमूर्ती बी पी जीवनरेड्डी यांच्या अध्यक्षतेखालील विधी आयोगाने त्यांच्या १७० व्या अहवालात २४ वर्षांपूर्वी म्हणजेच १९९९ मध्ये देखील नमूद केले होते की अशी निवडणूक प्रक्रिया सुधारणा करावयाचे झाल्यास ती अत्यंत विचारपूर्वक आणि साधक वादक विचार करून करावी लागेल. संसदेच्या स्थायी समितीने देखील ‘एक देश-एक निवडणूक’ संकल्पनेनुसार नुसार एकत्रित निवडणुका घेण्यावर भर दिला होता.

वरील विवेचनावरून एक लक्षात येते की ‘एक देश-एक निवडणूक’ ही संकल्पना तशी नवीन नाही. स्वात्रंत्योत्तर काळातील निवडणुकांच्या इतिहासावर नजर टाकली तर पहिल्या निवडणुकापासून सन १९६७ पर्यंत देशात लोकसभा आणि राज्यांच्या विधानसभांच्या निवडणुका एकत्रितच व्हायच्या. दुसऱ्या शब्दात सांगायचे म्हणजे ‘एक देश-एक निवडणूक’ ही संकल्पना प्रत्यक्षात १९६७ पर्यंत राबवली गेली आणि त्यामुळे ती या देशात अजिबात नवीन नाही. सन १९६८ आणि १९६९ मध्ये काही राज्यांच्या विधानसभा भंग केल्या गेल्याने व त्या राज्यातील विधानसभांच्या नव्याने निवडणुका घेणे अनिवार्य झाल्याने तेव्हापासून ‘एक देश-एक निवडणूक’ ही संकल्पना मोडीत निघाली ती आजतागायत!

‘एक देश-एक निवडणूक’ ही खरंच देशाची, देशातील नागरिकांची गरज आहे की केवळ राजकीय अथवा प्रशासकीय करण्यासाठी किंवा अन्य बाबीसाठी त्याबाबत चर्चा होत आहे? असा प्रश्न सर्वसामान्यांना पडणे स्वाभाविक आहे. सत्ताधारी भारतीय जनता पक्षाचा अर्थात या संकल्पनेला पाठिंबा आहे. मुख्य विरोधी पक्ष म्हणजे काँग्रेसने त्याबाबत सर्वसाधारणपणे विरोधी भूमिका घेतल्याचे दिसून येते. भारत हे संघराज्य असून ‘एक देश-एक निवडणूक’ या संकल्पने द्वारे संघराज्य स्वरूपालाच धक्का लागेल अशी काहीतरी संधीग्ध भूमिका काँग्रेस पक्षाची दिसून येते. बहुतांश क्षेत्रिय राजकीय पक्षांनी सुद्धा या संकल्पनेला थोड्याफार प्रमाणात विरोध केला असून काही पक्ष याबाबतीत सावधगिरीची भूमिका घेताना दिसून येत आहेत. एकंदरीतच जे ‘एक देश-एक निवडणूक’ या संकल्पनेला पाठिंबा देतात त्याबाबत त्यांची कारणमिमांसा असते की यामुळे निवडणुकावरील खर्च वाचेल, प्रशासन यामध्ये कायमस्वरूपी व्यस्त राहणार नाही वगैरे वगैरे. या संकल्पनेला विरोधी सूर असा आहे की अशा एकाच वेळेस लोकसभा आणि राज्यांच्या विधानसभांच्या निवडणुका घेतल्या तर जे निवडणुकांचे वारे तयार होईल त्यामध्ये राष्ट्रीय प्रश्नाकडे लक्ष अधिक आकर्षिले जाऊन त्यावर मतदान होईल व राज्यांच्या अस्मिता, प्रश्न गौण ठरतील; शिवाय ज्या पक्षाकडे जनतेला आकर्षित करून घेणारे किंवा राष्ट्रीय स्तरावर भुरळ घालणारे नेतृत्व आहे त्या पक्षाला जास्त फायदा होईल. सद्यस्थितीत भारतीय जनता पक्षाकडे पंतप्रधान श्री नरेंद्र मोदी यासारखे जनसामान्यांमध्ये आकर्षण असलेले राष्ट्रीय स्तरावरील नेतृत्व असल्याने त्या पक्षाला लोकसभेबरोबरच विधानसभांच्या निवडणुकांमध्येही निश्चित फायदा होईल ही विरोधकांची भूमिका आहे. ‘एक देश-एक निवडणूक’ ही बाब लोकशाहीला आणि ज्या नागरिकांसाठी ही लोकशाही व्यवस्था आहे त्यांच्यासाठी गरजेचे आहे का याचे राजकारण विरहित विश्लेषण होणे गरजेचे आहे. आणि एक त्रयस्थ विश्लेषक म्हणून आपण त्यावर जरा नजर टाकूया! लोकशाही व्यवस्थेचा उगम सुमारे अडीच हजार वर्षांपूर्वी ग्रीक देशात झाला आणि त्यामध्ये मूळ संकल्पना ही होती की राजाच्या किंवा मुठभर ताकदवान व्यक्तींच्या हातात शासन व्यवस्था राहून नागरिकांना जो त्रास होतो तो होऊ नये व त्याऐवजी सर्व नागरिकांना जे योग्य वाटते त्याप्रमाणेच निर्णय व्हावेत यासाठी सामूहिकपणे सर्व नागरिकांनी चालवलेली शासन व्यवस्था म्हणजे लोकशाही असावी. अर्थात अडीच हजार वर्षांपूर्वी ज्या अथेना या शहरात लोकशाहीचा प्रथम प्रत्यक्ष प्रयोग सुरू झाला त्यावेळेस त्या शहराची लोकसंख्या अल्प अशी कांही हजारांमध्ये होती व त्यामुळे तेथे प्रत्येक निर्णयात सर्वच नागरिकांचे मत घेणे शक्य होते.(अर्थात त्यामध्ये स्त्रिया गुलाम इ ना मतांचा हक्क नव्हता.) पुढे जशी जशी लोकसंख्या वाढत गेली आणि लोकशाही संकल्पना विकसित होत गेली त्यानुसार प्रत्येक नागरिकाला प्रत्येक निर्णय प्रक्रियेत सामावून घेणे केवळ अशक्य झाल्याने नागरिकांना ठराविक लोकसंख्येमागे त्यांचे लोकप्रतिनिधी निवडून द्यायचे आणि त्या लोकप्रतिनिधींनी शासन व्यवस्था किंवा सरकारी चालवायचे असे स्वरूप निर्माण झाले. या व्यवस्थेसाठी मग राज्यघटना आणि कायदे आले. या सर्वांमध्ये महत्त्वाचे महत्त्वाचा गाभा म्हणजे लोकप्रतिनिधी निवडून देणे हा असून त्यासाठी ‘निवडणूक प्रक्रिया’ हा भाग लोकशाहीचा आत्मा बनला. सध्या तरी जगात कोणत्याही लोकशाहीमध्ये ‘लोकप्रतिनिधी निवडून देणे’ आणि त्यायोग्य शासन तयार करणे याकरिता ‘निवडणुकी’ व्यतिरिक्त पर्याय नाही. त्यामुळे निवडणुका म्हणजे लोकशाही पद्धतीने शासन स्थापन करण्याची प्रक्रिया ही बाब रुजली गेली. भारतासारख्या भौगोलिक आणि लोकसंख्येच्या दृष्टीने अतिशय मोठ्या देशात निवडणुकांचे महत्त्व हे त्याच्या व्याप्तीमुळे आणखी गडद होते. या खंडप्राय देशात निवडणुका घेणे हे एक प्रचंड मोठे आव्हान असते. भारतात सद्य:स्थितीचा विचार केला तर राष्ट्रपती, लोकसभा, राज्यसभा, राज्यांच्या विधानसभा/विधान परिषदा, ग्रामपंचायती, पंचायत समित्या, जिल्हा परिषदा, नगरपरिषदा, नगरपालिका, महानगरपालिका इ करीत प्रत्यक्ष आणि अप्रत्यक्ष निवडणुका वर्षभर कोठे ना कुठे कायमस्वरूपी देशभर चालूच असतात. दुसऱ्या शब्दात सांगायचे म्हणजे देश कायमस्वरूपी निवडणूक प्रक्रियेत( Election mode) गुंतलेलाच असतो! निवडणुका घेण्यासाठी मतदार नोंदणी, त्यांचे दरवर्षी अध्यायवतीकरण, त्यावरील हरकती, मतदारांचे स्थलांतरण नोंद , मृत मतदार वगळणे , मतदारांची याद्यांची बुथनिहाय वर्गीकरण, त्यांचे प्रकाशन, मतदार ओळखपत्रे इत्यादी मूलभूत कामे १४० कोटी लोकसंख्येतील पात्र म्हणजे सुमारे ९५ कोटी मतदारांची प्रचंड माहिती अचूक तयार करून ठेवणे आणि ती केव्हाही वापरता येईल अशा पद्धतीने तजवीज ठेवणे त्याचबरोबर प्रत्यक्ष-अप्रत्यक्ष निवडणूक वेळापत्रकाप्रमाणे घेण्यासाठी दक्ष राहून त्या घेणे, त्याकरिता वैधानिक अधिसूचना काढणे, निवडणुका वेळापत्क ठरवणे, ते जाहीर करणे, आदर्श आचारसंहिता लागू करून तिची अंमलबजावणी करणे , उमेदवारी अर्ज स्वीकारणे, त्यांची छाननी करणे,प्रत्यक्ष निवडणूक घेणे, मतमोजणी करणे, निकाल जाहीर करणे अशा अगणित कामामध्ये शासकीय यंत्रणा अडकलेली म्हणजेच ‘गुंतलेली’ असते. देश पातळीवर निवडणुकांसाठी स्वतंत्र निवडणूक आयोग आणि राज्यांसाठी राज्य निवडणूक आयुक्त असले तरी ते वगळता देशभर निवडणुकांसाठी स्वतंत्र प्रशासकीय यंत्रणा नसते. महसूल, शिक्षण आणि अन्य सर्व विभागांचे अधिकारी आणि कर्मचारी हेच निवडणुकांचे काम पाहतात. अर्थात त्यावेळेस त्यांच्या मूळ दैनंदिन कामकाजावर आणि पर्यायाने ज्या सेवा त्यांच्या मार्फत जनतेला देणे अभिप्रेत आहे त्यावर विपरीत परिणाम होतो. त्या सर्व गोष्टीस प्रचंड खर्च येतो. ही झाली प्रशासकीय व्यस्ततेची बाजू, पण त्याचबरोबर कायमस्वरूपी कोणती ना कोणती निवडणूक चालू असल्याने आदर्श आचारसंहितेमुळे अनेक विकास कामे थांबतात आणि त्याचाही जनमानसावर कायमस्वरूपी विपरीत परिणाम होतो तो अधिक महत्त्वाचा. हे झाले शासकीय परिघातील निवडणूक लढवणाऱ्या व्यस्ततेचे दुष्परिणाम! पण राजकीय परिघात तर वर्षभर कायमस्वरूपी निवडणुकांचे वारे वाहत राहतात व त्यामुळे सामाजिक प्रश्न निर्माण झालेले असून लोकशाही विकृतीची कृतीकडे लोकशाही विकृतीकडे झुकलेली आहे का याची शंका यायला लागते. खरे तर लोकशाही ही शासन व्यवस्था सर्व नागरिकाच्या एकोप्याने चालणारी व्यवस्था असावी असे त्याचे गमक आहे; पण अलीकडे राजकीय पक्ष, त्यांच्या विचारधारा, सत्तेची महत्त्वाकांक्षा, आर्थिक आणि अन्य फायदे हे राजकारणाचा स्थायीभाव झाला आहे. त्यामुळे लोकशाहीत केवळ ‘लोकप्रतिनिधी’ ही संकल्पना राहिली नसून ती अतिविस्तारित होऊन ‘राजकीय कार्यकर्ते’ अशी त्याची व्यापकता झाली आहे, त्यात पक्ष सदस्य, पदाधिकारी, बूथ प्रतिनिधी पासून राज्य आणि देशभर संघटकांचे एक विस्तृत जाळे तयार झाले आहे. हि राजकीय यंत्रणा ते कायमस्वरूपी होणाऱ्या या ना त्या निवडणुकामुळे ते बाराही महिने अहोरात्र कार्यरत असते. हि राजकीय ‘कार्यकर्ते-संस्कृती’ इतकी खोलवर रुजली आहे कि या कार्यकर्त्यांपैकी अनेक कार्यकर्ते उपजीविकेसाठी अन्य कांही करतात किंवा नाही त्याचीही शंका यावी! अर्थात राजकीय पक्षांना त्यांच्या या कार्यकर्त्यांच्या फळीवर प्रचंड पैसा खर्च करावा लागत असणार नाही असे नाही. त्यामुळे राजकारण हा कार्यकर्ते वगैरेंच्या माध्यमातून एक व्यवसाय झाला की काय याबाबत सुद्धा शंका यावी इथपर्यंत परिस्थिती येऊन पोहोचली आहे. अर्थात यावर जो खर्च होतो तो मग प्रत्यक्षात उद्योग, व्यावसायिक इ ही देणगी स्वरूपात किंवा निवडणूक रोखे स्वरूपाच्या माध्यमातून राजकीय पक्षांना देऊन त्यातून भागविला जातो. बाराही महिने राजकीय पक्ष जो खर्च करतात तो देणगी किंवा निवडणूक रोखे या माध्यमातून भागविला जातो हे म्हणणे तसेच चुकीचे आहे कारण शेवटी हे व्यावसायिक किंवा उद्योगपती त्या देणग्या त्यांच्या नफ्यातूनच देतात हे सूर्यप्रकाशा इतके स्वच्छ आहे आणि शेवटी हा नफा जनता ज्या सेवा किंवा वस्तु विकत घेतात त्यातून होतो! म्हणजेच राजकारणावर बाराही महिने, सदासर्वकाळ जो पैसा राजकीय पक्ष वापरतात तो अंतिमतः जनतेच्या खिशातूनच जातो!!

निवडणुकावर शासनातर्फे आणि राजकीय पक्षांनी केलेला संपूर्ण खर्च हा नागरिकांचे खिशातून जातो हे सत्य स्वीकारले पाहिजे. एका संस्थेमार्फत (सेंटर फॉर मीडिया स्टडीज) केल्या गेलेल्या पाहणीतिल अहवालानुसार २०१९ च्या लोकसभेच्या निवडणुकीमध्ये राजकीय पक्षांनी सुमारे रुपये 55 हजार कोटी इतका खर्च केला होता. जर लोकसभा, विधानसभा, स्थानिक स्वराज्य संस्था इत्यादींच्या निवडणुकांवर राजकीय पक्ष जो खर्च करतात त्याचा ढोबळमानाने अंदाज घेतला तर तो कदाचित भारताच्या सकल उत्पादनाच्या एक ते दोन टक्के सुद्धा असू शकतो. कोणत्या ना कोणत्या निवडणुकांसाठी राजकीय कार्यकर्ते कार्यरत ठेवणे अपरिहार्य असते त्यामुळे संपूर्ण पाच वर्षे राजकारण आणि निवडणूक खर्च होत राहतो.

दुसरे असे की लोकशाहीमध्ये एकदा लोकप्रतिनिधी निवडून जाऊन त्यांनी सरकार तयार केल्यानंतर ते राजकीय पक्षाचे प्रतिनिधी न राहता ते केंद्र,राज्य किंवा स्थानिक स्वराज्य संस्थेचे सर्वांचे शासनकर्ते होतात; त्यांनी राजकारण करणे अपेक्षित नसते. पण कायमस्वरूपी होत असणाऱ्या निवडणुकांमुळे लोकप्रतिनिधींना कायमस्वरूपी राजकीय पक्ष प्रतिनिधी किंवा पक्षनेता म्हणून वावरावे लागते व कायम प्रचाराच्या ‘मोड’मध्ये असावे लागते. त्याचा परिणाम म्हणजे ही लोकशाही न राहता ‘राजकारणशाही’ होते आणि तशी ती झालेली आहे.

तिसरी महत्त्वाची गोष्ट म्हणजे निवडणुकीसाठी स्वतंत्र प्रशासकीय यंत्र नसल्याने वर्षभर कोणत्या ना कोणत्या निवडणुकीत यंत्रणा व्यस्त राहते आणि त्यापेक्षाही महत्त्वाचे म्हणजे आदर्श आचारसंहितामुळे विकास कामांना खेळ बसते हे सर्व देशाच्या दैनंदिन प्रशासनासाठी विकासासाठी अर्थव्यवस्थेसाठी आणि सर्वात महत्त्वाचे म्हणजे लोकशाहीसाठी घातक आहे.

हे सर्व टाळाव्याचे असेल तर ‘एक देश-एक निवडणूक’ हा पर्याय कधी ना कधी अवलंबिला जाणे आवश्यक आहे, अन्यथा त्यामुळे देशाचे अपरिमित नुकसान होतच राहील. अर्थात आता जी एक देश ‘एक देश-एक निवडणूक’ हि संकल्पना आहे ती आता तशी जुनाट झालेली असून त्याप्रमाणे जर ती राबवली गेली तर त्याचे पाहिजे तितके चांगले परिणाम दिसून येणार नाहीत.

लोकशाहीमध्ये शासन व्यवस्था किंवा सरकारे स्थापन करण्यासाठी मतदार प्रत्यक्ष मतदान तीन वेळेस करतो, ते म्हणजे लोकसभा, विधानसभा आणि स्थानिक स्वराज्य संस्था याकरिता. देशात जर ९५ कोटी मतदार असतील तर या त्रिस्तरीय शासन व्यवस्थेसाठी प्रत्येक पाच वर्षाच्या कालखंडात प्रत्येक मतदार तीन वेळेस म्हणजेच एकूण २८५ कोटी मतदारांनी प्रत्यक्ष मतदान करणे अभिप्रेत आहे. त्यामुळे ‘एक देश-एक निवडणूक’ ही संकल्पना १९९३ नंतर ज्या ७३ आणि ७४ व्या घटना दुरुस्त्या झाल्या त्यानुसार बदलली असून त्यामध्ये लोकसभा, विधानसभा करितांच्या निवडणुकामध्ये स्थानिक स्वराज्य संस्थांच्या निवडणुकांचे अंतर्भाव होतो. जर स्थानिक स्वराज्य संस्थांच्या निवडणुका ‘एक देश-एक निवडणूक’ या संकल्पनेत आणला नाही तर या मूळ संकल्पना ला काहीच अर्थ राहणार नाही आणि स्थानिक स्वराज्य संस्थांच्या निवडणुकांच्या रूपात ‘राजकारणशाही’मुळे निर्माण झालेले प्रश्न चालूच राहतील.

या पार्श्वभूमीवर ‘एक देश-एक निवडणूक’ या संकल्पनेत “लोकसभा, विधानसभा आणि स्थानिक स्वराज्य संस्था” यांच्या एकाच वेळेस निवडणुका अशीच संकल्पना ठेवावी लागेल. एकदा देशाने ही संकल्पना राबवायची ठरवली तर ते फार कठीण नाही. अर्थात त्याकरिता संविधानात आणि लोकप्रतिनिधी अधिनियम आणि अन्य संबंधित कायद्यात बदल करावे लागतील. हे बदल एक तात्पुरती व्यवस्था म्हणून आणि दुसरे म्हणजे हि व्यवस्था पुढे निरंतर चालू ठेवणे यासाठी असतील. तात्पुरते बदल हे लोकसभा, विधानसभा, स्थानिक स्वराज्य संस्थांपैकी काहींचा कालावधी वाढवावा लागेल किंवा काहींचा कमी करावा लागेल यासाठी. तर ‘एक देश-एक निवडणूक’ ही संकल्पना कायमस्वरूपी राबविण्यासाठी या सर्व संस्थांचा कार्यकाल पाच वर्ष अनिवार्य करावा लागेल. त्यासाठी लोकसभेच्या बाबतीत संविधानाच्या अनुच्छेद ८३ मध्ये आणि विधानसभांच्या बाबतीत अनुच्छेद १७२ मध्ये सुधारणा करून स्थानिक स्वराज्य संस्थांच्या बाबतीत जो पाच वर्षाची कालमर्यादा अनुछेद २४३-इ २४३ -यू अन्वये ज्या तरतुदी केलेल्या आहेत तशा तरतुदी कराव्या लागतील. म्हणजेच नवीन राज्य, स्थानिक संस्था निर्माण होणे वगैरे सारखी अपवादात्मक परिस्थितीत निर्माण होऊन जर मध्यावधी निवडणुका घ्याव्या लागल्या तर त्या पाच वर्षांपैकी फक्त उर्वरित कालावधीसाठीच त्यांचा कार्यकाल असेल व नंतर पुन्हा एकाच वेळेस निवडणुका होतील. लोकसभा, विधानसभा आणि स्वराज्य संस्थां पाच वर्षांच्या आत भंग करण्याची वेळच येऊ नये म्हणून देखील संविधानामध्ये यथार्थ बदल करावे लागतील. उदाहरणार्थ, मोठ्या प्रमाणात पक्ष फुटी होऊन अस्थिरता येऊ नये याकरिता संविधानाच्या परिशिष्ट दहा मध्ये सुधारणा करावी लागेल. ती सुधारणा सर्वसाधारणपणे अशी असू शकेल कि, जर लोकप्रतिनिधीना पक्ष बदल करायचा असेल आणि त्यांची संख्या कितीही असली तरी ते आपोआप अपात्र झाले असे समजले जावे. यामुळे सरकारे अस्थिर होऊन संस्था भंग करण्याच्या प्रश्न अस्तित्वात असणार नाही. त्याचबरोबर अन्य संविधान सुधारणा अशी असावी कि,जर एखाद्या लोकप्रतिनिधीचे पद मृत्यू, राजीनामा किंवा अन्य कोणत्याही कारणास्तव रिक्त झाले तर त्या बाबतीत निवडणुकीत जो दोन क्रमांकाचा उमेदवार आपोआप ती जागा घेऊ शकेल जेणेकरून ती रिक्त जागा भरण्यासाठी निवडणुकीची आवश्यकता भासणार नाही. अर्थात, वरील सूचना या प्रतिनिधिक स्वरूपाच्या असून तशा प्रकारच्या संविधानिक आणि संबंधित कायदा बदल करण्याकरिता पूर्ण अभ्यासाअंती हा बदल घडवावा लागेल. एक मात्र निश्चित कि ‘एक देश-एक निवडणूक’ ही संकल्पना व्यवहारी स्वरूपात राबविणे निश्चितपणे शक्य आहे. त्याकरिता नागरिकांचा दबाव आणि राजकीय नेतृत्वाची इच्छा असणे अपेक्षित आहे.

लोकशाही व्यवस्थेचा उगम सुमारे अडीच हजार वर्षांपूर्वी ग्रीक देशात झाला आणि त्यामध्ये मूळ संकल्पना ही होती की राजाच्या किंवा मुठभर ताकदवान व्यक्तींच्या हातात शासन व्यवस्था राहून नागरिकांना जो त्रास होतो तो होऊ नये व त्याऐवजी सर्व नागरिकांना जे योग्य वाटते त्याप्रमाणेच निर्णय व्हावेत यासाठी सामूहिकपणे सर्व नागरिकांनी चालवलेली शासन व्यवस्था म्हणजे लोकशाही असावी. अर्थात अडीच हजार वर्षांपूर्वी ज्या अथेना या शहरात लोकशाहीचा प्रथम प्रत्यक्ष प्रयोग सुरू झाला त्यावेळेस त्या शहराची लोकसंख्या अल्प अशी कांही हजारांमध्ये होती व त्यामुळे तेथे प्रत्येक निर्णयात सर्वच नागरिकांचे मत घेणे शक्य होते.(अर्थात त्यामध्ये स्त्रिया गुलाम इ ना मतांचा हक्क नव्हता.) पुढे जशी जशी लोकसंख्या वाढत गेली आणि लोकशाही संकल्पना विकसित होत गेली त्यानुसार प्रत्येक नागरिकाला प्रत्येक निर्णय प्रक्रियेत सामावून घेणे केवळ अशक्य झाल्याने नागरिकांना ठराविक लोकसंख्येमागे त्यांचे लोकप्रतिनिधी निवडून द्यायचे आणि त्या लोकप्रतिनिधींनी शासन व्यवस्था किंवा सरकारी चालवायचे असे स्वरूप निर्माण झाले. या व्यवस्थेसाठी मग राज्यघटना आणि कायदे आले. या सर्वांमध्ये महत्त्वाचे महत्त्वाचा गाभा म्हणजे लोकप्रतिनिधी निवडून देणे हा असून त्यासाठी ‘निवडणूक प्रक्रिया’ हा भाग लोकशाहीचा आत्मा बनला. सध्या तरी जगात कोणत्याही लोकशाहीमध्ये ‘लोकप्रतिनिधी निवडून देणे’ आणि त्यायोग्य शासन तयार करणे याकरिता ‘निवडणुकी’ व्यतिरिक्त पर्याय नाही. त्यामुळे निवडणुका म्हणजे लोकशाही पद्धतीने शासन स्थापन करण्याची प्रक्रिया ही बाब रुजली गेली. भारतासारख्या भौगोलिक आणि लोकसंख्येच्या दृष्टीने अतिशय मोठ्या देशात निवडणुकांचे महत्त्व हे त्याच्या व्याप्तीमुळे आणखी गडद होते. या खंडप्राय देशात निवडणुका घेणे हे एक प्रचंड मोठे आव्हान असते. भारतात सद्य:स्थितीचा विचार केला तर राष्ट्रपती, लोकसभा, राज्यसभा, राज्यांच्या विधानसभा/विधान परिषदा, ग्रामपंचायती, पंचायत समित्या, जिल्हा परिषदा, नगरपरिषदा, नगरपालिका, महानगरपालिका इ करीत प्रत्यक्ष आणि अप्रत्यक्ष निवडणुका वर्षभर कोठे ना कुठे कायमस्वरूपी देशभर चालूच असतात. दुसऱ्या शब्दात सांगायचे म्हणजे देश कायमस्वरूपी निवडणूक प्रक्रियेत( Election mode) गुंतलेलाच असतो! निवडणुका घेण्यासाठी मतदार नोंदणी, त्यांचे दरवर्षी अध्यायवतीकरण, त्यावरील हरकती, मतदारांचे स्थलांतरण नोंद , मृत मतदार वगळणे , मतदारांची याद्यांची बुथनिहाय वर्गीकरण, त्यांचे प्रकाशन, मतदार ओळखपत्रे इत्यादी मूलभूत कामे १४० कोटी लोकसंख्येतील पात्र म्हणजे सुमारे ९५ कोटी मतदारांची प्रचंड माहिती अचूक तयार करून ठेवणे आणि ती केव्हाही वापरता येईल अशा पद्धतीने तजवीज ठेवणे त्याचबरोबर प्रत्यक्ष-अप्रत्यक्ष निवडणूक वेळापत्रकाप्रमाणे घेण्यासाठी दक्ष राहून त्या घेणे, त्याकरिता वैधानिक अधिसूचना काढणे, निवडणुका वेळापत्क ठरवणे, ते जाहीर करणे, आदर्श आचारसंहिता लागू करून तिची अंमलबजावणी करणे , उमेदवारी अर्ज स्वीकारणे, त्यांची छाननी करणे,प्रत्यक्ष निवडणूक घेणे, मतमोजणी करणे, निकाल जाहीर करणे अशा अगणित कामामध्ये शासकीय यंत्रणा अडकलेली म्हणजेच ‘गुंतलेली’ असते. देश पातळीवर निवडणुकांसाठी स्वतंत्र निवडणूक आयोग आणि राज्यांसाठी राज्य निवडणूक आयुक्त असले तरी ते वगळता देशभर निवडणुकांसाठी स्वतंत्र प्रशासकीय यंत्रणा नसते. महसूल, शिक्षण आणि अन्य सर्व विभागांचे अधिकारी आणि कर्मचारी हेच निवडणुकांचे काम पाहतात. अर्थात त्यावेळेस त्यांच्या मूळ दैनंदिन कामकाजावर आणि पर्यायाने ज्या सेवा त्यांच्या मार्फत जनतेला देणे अभिप्रेत आहे त्यावर विपरीत परिणाम होतो. त्या सर्व गोष्टीस प्रचंड खर्च येतो. ही झाली प्रशासकीय व्यस्ततेची बाजू, पण त्याचबरोबर कायमस्वरूपी कोणती ना कोणती निवडणूक चालू असल्याने आदर्श आचारसंहितेमुळे अनेक विकास कामे थांबतात आणि त्याचाही जनमानसावर कायमस्वरूपी विपरीत परिणाम होतो तो अधिक महत्त्वाचा. हे झाले शासकीय परिघातील निवडणूक लढवणाऱ्या व्यस्ततेचे दुष्परिणाम! पण राजकीय परिघात तर वर्षभर कायमस्वरूपी निवडणुकांचे वारे वाहत राहतात व त्यामुळे सामाजिक प्रश्न निर्माण झालेले असून लोकशाही विकृतीची कृतीकडे लोकशाही विकृतीकडे झुकलेली आहे का याची शंका यायला लागते. खरे तर लोकशाही ही शासन व्यवस्था सर्व नागरिकाच्या एकोप्याने चालणारी व्यवस्था असावी असे त्याचे गमक आहे; पण अलीकडे राजकीय पक्ष, त्यांच्या विचारधारा, सत्तेची महत्त्वाकांक्षा, आर्थिक आणि अन्य फायदे हे राजकारणाचा स्थायीभाव झाला आहे. त्यामुळे लोकशाहीत केवळ ‘लोकप्रतिनिधी’ ही संकल्पना राहिली नसून ती अतिविस्तारित होऊन ‘राजकीय कार्यकर्ते’ अशी त्याची व्यापकता झाली आहे, त्यात पक्ष सदस्य, पदाधिकारी, बूथ प्रतिनिधी पासून राज्य आणि देशभर संघटकांचे एक विस्तृत जाळे तयार झाले आहे. हि राजकीय यंत्रणा ते कायमस्वरूपी होणाऱ्या या ना त्या निवडणुकामुळे ते बाराही महिने अहोरात्र कार्यरत असते. हि राजकीय ‘कार्यकर्ते-संस्कृती’ इतकी खोलवर रुजली आहे कि या कार्यकर्त्यांपैकी अनेक कार्यकर्ते उपजीविकेसाठी अन्य कांही करतात किंवा नाही त्याचीही शंका यावी! अर्थात राजकीय पक्षांना त्यांच्या या कार्यकर्त्यांच्या फळीवर प्रचंड पैसा खर्च करावा लागत असणार नाही असे नाही. त्यामुळे राजकारण हा कार्यकर्ते वगैरेंच्या माध्यमातून एक व्यवसाय झाला की काय याबाबत सुद्धा शंका यावी इथपर्यंत परिस्थिती येऊन पोहोचली आहे. अर्थात यावर जो खर्च होतो तो मग प्रत्यक्षात उद्योग, व्यावसायिक इ ही देणगी स्वरूपात किंवा निवडणूक रोखे स्वरूपाच्या माध्यमातून राजकीय पक्षांना देऊन त्यातून भागविला जातो. बाराही महिने राजकीय पक्ष जो खर्च करतात तो देणगी किंवा निवडणूक रोखे या माध्यमातून भागविला जातो हे म्हणणे तसेच चुकीचे आहे कारण शेवटी हे व्यावसायिक किंवा उद्योगपती त्या देणग्या त्यांच्या नफ्यातूनच देतात हे सूर्यप्रकाशा इतके स्वच्छ आहे आणि शेवटी हा नफा जनता ज्या सेवा किंवा वस्तु विकत घेतात त्यातून होतो! म्हणजेच राजकारणावर बाराही महिने, सदासर्वकाळ जो पैसा राजकीय पक्ष वापरतात तो अंतिमतः जनतेच्या खिशातूनच जातो!!

निवडणुकावर शासनातर्फे आणि राजकीय पक्षांनी केलेला संपूर्ण खर्च हा नागरिकांचे खिशातून जातो हे सत्य स्वीकारले पाहिजे. एका संस्थेमार्फत (सेंटर फॉर मीडिया स्टडीज) केल्या गेलेल्या पाहणीतिल अहवालानुसार २०१९ च्या लोकसभेच्या निवडणुकीमध्ये राजकीय पक्षांनी सुमारे रुपये 55 हजार कोटी इतका खर्च केला होता. जर लोकसभा, विधानसभा, स्थानिक स्वराज्य संस्था इत्यादींच्या निवडणुकांवर राजकीय पक्ष जो खर्च करतात त्याचा ढोबळमानाने अंदाज घेतला तर तो कदाचित भारताच्या सकल उत्पादनाच्या एक ते दोन टक्के सुद्धा असू शकतो. कोणत्या ना कोणत्या निवडणुकांसाठी राजकीय कार्यकर्ते कार्यरत ठेवणे अपरिहार्य असते त्यामुळे संपूर्ण पाच वर्षे राजकारण आणि निवडणूक खर्च होत राहतो.

दुसरे असे की लोकशाहीमध्ये एकदा लोकप्रतिनिधी निवडून जाऊन त्यांनी सरकार तयार केल्यानंतर ते राजकीय पक्षाचे प्रतिनिधी न राहता ते केंद्र,राज्य किंवा स्थानिक स्वराज्य संस्थेचे सर्वांचे शासनकर्ते होतात; त्यांनी राजकारण करणे अपेक्षित नसते. पण कायमस्वरूपी होत असणाऱ्या निवडणुकांमुळे लोकप्रतिनिधींना कायमस्वरूपी राजकीय पक्ष प्रतिनिधी किंवा पक्षनेता म्हणून वावरावे लागते व कायम प्रचाराच्या ‘मोड’मध्ये असावे लागते. त्याचा परिणाम म्हणजे ही लोकशाही न राहता ‘राजकारणशाही’ होते आणि तशी ती झालेली आहे.

तिसरी महत्त्वाची गोष्ट म्हणजे निवडणुकीसाठी स्वतंत्र प्रशासकीय यंत्र नसल्याने वर्षभर कोणत्या ना कोणत्या निवडणुकीत यंत्रणा व्यस्त राहते आणि त्यापेक्षाही महत्त्वाचे म्हणजे आदर्श आचारसंहितामुळे विकास कामांना खेळ बसते हे सर्व देशाच्या दैनंदिन प्रशासनासाठी विकासासाठी अर्थव्यवस्थेसाठी आणि सर्वात महत्त्वाचे म्हणजे लोकशाहीसाठी घातक आहे.

हे सर्व टाळाव्याचे असेल तर ‘एक देश-एक निवडणूक’ हा पर्याय कधी ना कधी अवलंबिला जाणे आवश्यक आहे, अन्यथा त्यामुळे देशाचे अपरिमित नुकसान होतच राहील. अर्थात आता जी एक देश ‘एक देश-एक निवडणूक’ हि संकल्पना आहे ती आता तशी जुनाट झालेली असून त्याप्रमाणे जर ती राबवली गेली तर त्याचे पाहिजे तितके चांगले परिणाम दिसून येणार नाहीत.

लोकशाहीमध्ये शासन व्यवस्था किंवा सरकारे स्थापन करण्यासाठी मतदार प्रत्यक्ष मतदान तीन वेळेस करतो, ते म्हणजे लोकसभा, विधानसभा आणि स्थानिक स्वराज्य संस्था याकरिता. देशात जर ९५ कोटी मतदार असतील तर या त्रिस्तरीय शासन व्यवस्थेसाठी प्रत्येक पाच वर्षाच्या कालखंडात प्रत्येक मतदार तीन वेळेस म्हणजेच एकूण २८५ कोटी मतदारांनी प्रत्यक्ष मतदान करणे अभिप्रेत आहे. त्यामुळे ‘एक देश-एक निवडणूक’ ही संकल्पना १९९३ नंतर ज्या ७३ आणि ७४ व्या घटना दुरुस्त्या झाल्या त्यानुसार बदलली असून त्यामध्ये लोकसभा, विधानसभा करितांच्या निवडणुकामध्ये स्थानिक स्वराज्य संस्थांच्या निवडणुकांचे अंतर्भाव होतो. जर स्थानिक स्वराज्य संस्थांच्या निवडणुका ‘एक देश-एक निवडणूक’ या संकल्पनेत आणला नाही तर या मूळ संकल्पना ला काहीच अर्थ राहणार नाही आणि स्थानिक स्वराज्य संस्थांच्या निवडणुकांच्या रूपात ‘राजकारणशाही’मुळे निर्माण झालेले प्रश्न चालूच राहतील.

या पार्श्वभूमीवर ‘एक देश-एक निवडणूक’ या संकल्पनेत “लोकसभा, विधानसभा आणि स्थानिक स्वराज्य संस्था” यांच्या एकाच वेळेस निवडणुका अशीच संकल्पना ठेवावी लागेल. एकदा देशाने ही संकल्पना राबवायची ठरवली तर ते फार कठीण नाही. अर्थात त्याकरिता संविधानात आणि लोकप्रतिनिधी अधिनियम आणि अन्य संबंधित कायद्यात बदल करावे लागतील. हे बदल एक तात्पुरती व्यवस्था म्हणून आणि दुसरे म्हणजे हि व्यवस्था पुढे निरंतर चालू ठेवणे यासाठी असतील. तात्पुरते बदल हे लोकसभा, विधानसभा, स्थानिक स्वराज्य संस्थांपैकी काहींचा कालावधी वाढवावा लागेल किंवा काहींचा कमी करावा लागेल यासाठी. तर ‘एक देश-एक निवडणूक’ ही संकल्पना कायमस्वरूपी राबविण्यासाठी या सर्व संस्थांचा कार्यकाल पाच वर्ष अनिवार्य करावा लागेल. त्यासाठी लोकसभेच्या बाबतीत संविधानाच्या अनुच्छेद ८३ मध्ये आणि विधानसभांच्या बाबतीत अनुच्छेद १७२ मध्ये सुधारणा करून स्थानिक स्वराज्य संस्थांच्या बाबतीत जो पाच वर्षाची कालमर्यादा अनुछेद २४३-इ २४३ -यू अन्वये ज्या तरतुदी केलेल्या आहेत तशा तरतुदी कराव्या लागतील. म्हणजेच नवीन राज्य, स्थानिक संस्था निर्माण होणे वगैरे सारखी अपवादात्मक परिस्थितीत निर्माण होऊन जर मध्यावधी निवडणुका घ्याव्या लागल्या तर त्या पाच वर्षांपैकी फक्त उर्वरित कालावधीसाठीच त्यांचा कार्यकाल असेल व नंतर पुन्हा एकाच वेळेस निवडणुका होतील. लोकसभा, विधानसभा आणि स्वराज्य संस्थां पाच वर्षांच्या आत भंग करण्याची वेळच येऊ नये म्हणून देखील संविधानामध्ये यथार्थ बदल करावे लागतील. उदाहरणार्थ, मोठ्या प्रमाणात पक्ष फुटी होऊन अस्थिरता येऊ नये याकरिता संविधानाच्या परिशिष्ट दहा मध्ये सुधारणा करावी लागेल. ती सुधारणा सर्वसाधारणपणे अशी असू शकेल कि, जर लोकप्रतिनिधीना पक्ष बदल करायचा असेल आणि त्यांची संख्या कितीही असली तरी ते आपोआप अपात्र झाले असे समजले जावे. यामुळे सरकारे अस्थिर होऊन संस्था भंग करण्याच्या प्रश्न अस्तित्वात असणार नाही. त्याचबरोबर अन्य संविधान सुधारणा अशी असावी कि,जर एखाद्या लोकप्रतिनिधीचे पद मृत्यू, राजीनामा किंवा अन्य कोणत्याही कारणास्तव रिक्त झाले तर त्या बाबतीत निवडणुकीत जो दोन क्रमांकाचा उमेदवार आपोआप ती जागा घेऊ शकेल जेणेकरून ती रिक्त जागा भरण्यासाठी निवडणुकीची आवश्यकता भासणार नाही. अर्थात, वरील सूचना या प्रतिनिधिक स्वरूपाच्या असून तशा प्रकारच्या संविधानिक आणि संबंधित कायदा बदल करण्याकरिता पूर्ण अभ्यासाअंती हा बदल घडवावा लागेल. एक मात्र निश्चित कि ‘एक देश-एक निवडणूक’ ही संकल्पना व्यवहारी स्वरूपात राबविणे निश्चितपणे शक्य आहे. त्याकरिता नागरिकांचा दबाव आणि राजकीय नेतृत्वाची इच्छा असणे अपेक्षित आहे.

ही संकल्पना राबवली गेली तर लोकशाही निश्चितपणे सुदृढ होऊ शकेल हे तितकेच खरे!
