Recently, on the 1st of September 2023, Union Parliamentary Affairs Minister Shri Pralhad Joshi announced a committee, with the esteemed former President Shri Ram Nath Kovind at its helm, entrusted with the weighty task of deliberating upon the prospect of “One Nation – One Election.”

The concept itself is not a novel composition; it carries the echoes of discussions initiated by the Bharatiya Janata Party and Prime Minister Shri Narendra Modi since 2014. Prime Minister Modi, during his 2019 Independence Day address, seamlessly wove the success of ‘One Country One Taxation’ through the implementation of GST into the rising crescendo of ‘One Nation – One Election.’ The Law Commission, parliamentary ensembles, and historical precedents have all played their roles in this enduring overture.

मी वेळ मिळेल तसे वेगवेगळ्या ठिकाणी माझे दैनंदिन १२ कि मी चे धावणे दररोज करीत असतो. एक दिवशी सकाळी सावित्रीबाई फुले पुणे विद्यापीठाच्या निसर्गरम्य आवारात धावत असतांना एक ७०-८० च्या पुढेच ज्यांचे वय असावे अशा वयोवृद्ध ६-७ काकांचा घोळका जगात आणि देशात काय चालले आहे, पूर्वी सगळे कसे चांगले होते अशा स्वरूपाचे वादविवाद करीत दृष्टीस पडला. त्यातील एक काका अतिशय तावातावाने देशात आणि महाराष्ट्रात राजकारणाचा बट्ट्याबोळ झाला आहे हे इतरांना पटवून देत होते. बहुतेकांचा त्यांच्या मतास दुजोरा असावा किंवा कशाला वाद वाढवावयाचा या वयाने येणाऱ्या परिपक्वतेमुळे त्यांना कोणीही विरोध करीत नव्हते. मी माझ्या वेगाने पुढे निघू गेलो. पण त्या काकांनी मनात एक अस्वस्थता निर्माण केली होती. राजकारणाचा आणि राजकारण ज्या लोकशाहीसाठी निर्माण झाले आहे त्या लोकशाहीचा खरोखरच बट्ट्याबोळ होत आहे का कि काकांचे विचार अनाठायी आहेत? विशेषतः, अनेक राज्यात एका पक्षाचे उमेदवार निवडून येऊन दुसऱ्याच पक्षाचे सरकार बनणे, पक्षांतराबाबत कांहीही विधिनिषेध न बाळगणे इ मध्ये वाढ झाली आहे हे हि नाकारून चालणार नाही. महाराष्ट्रात तर २०१९ च्या विधानसभेच्या निवडणुकांनंतर जे काही सुरु झाले आहे ते पाहून हेच ते देशात प्रगत आणि परिपक्व राज्य म्हणून गणले जात होत तेच आहे का यांचीही शंका येऊ लागते. निवडणुकांनंतर पक्षांनी जुन्या आणि परंपरागत मित्र पक्षाची संगत सोडणे, राज्यपालांची वादग्रस्त कारकीर्द कि ज्याची दखल सर्वोच्च न्यायालयास सुद्धा , घ्यावी लागली, प्रथम शिवसेना आणि नंतर राष्ट्रवादी पक्षातील फूट , त्यात निवडणूक आयोगाची भूमिका, सर्वोच्च न्यायालयात गेलेली आणि लांबलेली प्रकरणे, विधानसभाध्यक्षांची भूमिका असे अनेक गुंतागुंतीचे विषय निर्माण झाले आणि त्यामध्ये लोकहित हरवून गेले. देशाचे संविधान लागू होऊन ७३ वर्षे झाली तरी हा गोंधळ का व्हावा? यावर काही उपाय नाही का? या प्रश्नावर मी विचार केला आणि त्यावर तोडगा काढण्यासाठी कांही उपाययोजना आहेत का याचा माझ्या परीने थोडक्यात मागोवा घेतला. अर्थात, मी जे माझे विचार मांडले आहेत त्यापेक्षा वेगळे आणि प्रभावी उपाय असू शकतील पण मग सर्व जनतेने पुढाकार घेऊन तोडगा काढणे अपरिहार्य झाले आहे असे माझे मत आहे.

माझे विचार पुढे देत आहे.

वास्तविकतः कालपरत्वे वैयक्तिक स्वार्थ आणि काही अंशी विचारधारांचा अतिरेकी प्रभाव या दोन प्रमुख बाबींमुळे लोकशाही क्षीण होत चालली आहे, हे सत्य नाकारून चालणार नाही. वैयक्तिक स्वार्थ हा प्रामुख्याने अर्थार्जनाच्या वाटेने जाणारा असल्याने जागतिक पातळीपासून गाव पातळीपर्यंत लोकशाही संस्था या भांडवलशाहीच्या बटिक बनत चालल्या आहेत. अर्थशास्त्राचे नोबेल पारितोषिक विजेते जोसेफ स्टिग्लीट्झ यांनी सध्याच्या लोकशाहीची व्याख्या ही म्हणजेच द्रव्याच्या अंकित जाऊन लोकांची, लोकांकडून व लोकांकरिताची शासनव्यवस्था याऐवजी १% लोकांची , १% लोकांकडून आणि १% लोकांकरिता असलेली व्यवस्था म्हणजे लोकशाही अशी सुधारित केली आहे. त्यामध्ये १% हे जगातील सर्वांत धनवान असलेला लोकांचा समूह अभिप्रेत आहे.

सन २०१८ मध्ये राज्य निवडणूक आयोगाने निवडणुकीतील धन, बहुबलता व प्रसारमाध्यमे यांचा गैरवापर कसा थांबवता किंवा कमी करता येईल, याकरता एक कार्यशाळा मुंबई विद्यापीठांमध्ये घेतली होती व त्यामध्ये मी सहभागी झालो होतो. सर्वच वक्ते अत्यंत पोटतिडकीने हा निवडणुकीतील वरील बाबींचा गैरव्यवहार कसा कमी करता येईल, यावर आपापले अभ्यासपूर्ण विचार मांडीत होते. अर्थात, त्याचे मला मनोमन हसू येत होते. कारण एखाद्याचे शरीर कर्करोगाने जर्जर झाले असेल तर त्याला बरे व्हावयासाठी वरवरचे उपचार पुरे पडत नाहीत तर हा रोग कायमस्वरूपी कसा बरा होऊ शकतो त्याच्या मुळाशी जाऊन त्यावर जालीम उपाययोजनाच करावी लागते. निवडणुकांमध्ये उमेदवार किंवा राजकीय पक्ष पैसा का खर्च करतात, याचे गुपित दोन गोष्टींमध्ये दडलेले आहे- एक तर जगातील सर्व देशांमध्ये गेल्या 40-50 वर्षांत भांडवलशाही आणि बाजारू अर्थशास्त्राने लोकशाही संस्थांवर हळूहळू वर्चस्व वाढवून आता लोकशाहीवर भांडवलशाहीचे इतके वर्चस्व वाढले आहे की, भांडवलशाहीने लोकशाहीला गिळंकृत केले आहे असे वाटण्यासारखी परिस्थिती आहे. त्याचबरोबर संपत्तीचे केंद्रीकरण इतके झपाट्याने होत गेले आणि आता ते विकोपाला जात असून जोसेफ स्टिग्लीट्झ  यांच्या म्हणण्याप्रमाणे केवळ १ टक्के लोकांकडे सर्वांत जास्त संपत्ती आहे. ते जगावर सत्ता गाजवीत आहेत. दुसरे म्हणजे लोकशाहीतील लोकप्रतिनिधी यांनी समाजसेवा हे व्रत समजण्याऐवजी भांडवलशाहीच्या प्रवाहात आणि त्यांच्या कह्यात पुरेपूर आले असून, त्यामध्ये ते पूर्णपणे गुरफटले गेले आहेत. या पार्श्वभूमीवर मी त्या कार्यशाळेतील चर्चा ही बाळबोध असल्याची आणि जोपर्यंत संपूर्ण लोकशाहीला भांडवलशाहीच्या विळख्यातून बाहेर काढायचा प्रयत्न होत नाही तोपर्यंत निवडणुकांमध्ये धनसंपत्तीचा गैरवापर कमी करण्याचे प्रयत्न म्हणजे सूर्याला दिवा दाखवण्यासारखे आहे हे स्पष्ट केले. अशा परिस्थितीत सध्याची लोकशाही पैशांची, पैशाकडून आणि पैशांकरता झालेली निवडणूक आयोगाने त्रयस्थ व स्वायत्त संस्था म्हणून देशाला नवी दिशा द्यावी असेच सुचविले. अर्थात, माझे हे विचार पचनासाठी तितकेसे सोपे नाहीत, हे मलाही माहीत आहे; पण मग त्याशिवाय दुसरा अन्य उपाय सध्या तरी क्षितिजावर दिसून येत नाही.

लोकशाहीचे आरोग्य सुदृढ करावयाचे झाले तर त्यासाठी काय केले पाहिजे, हा मुद्दा देशाच्या आणि जगाच्या अजेंड्यावर आला पाहिजे. तसा तो बऱ्यापैकी दुर्लक्षिला गेला आहे हे मान्य करावे लागेल. रोजगार वृद्धी, आर्थिक समानता, आरोग्य सुविधा, पर्यावरणाचा ऱ्हास, भरकटणारी अर्थव्यवस्था, कधीही कोसळू शकेल असा बँकिंग व्यवसायाचा हिंदोळे घेत असलेला डोलारा, आण्विक युद्धाची कायमस्वरूपाची भीती, पाणी आणि ऊर्जेचे वाढणारे दुर्भिक्ष, वाढती लोकसंख्या, किळसवाणी नागरीकरण अशा अगणित समस्या जगापुढे आ वासून उभ्या असल्या, तरी त्या सर्वांवर समर्पक तोडगे काढून त्यांची अंमलबजावणी करण्यासाठी जी सक्षम व्यवस्था जागतिक, देश पातळीवर व देशांतर्गत असावी लागते ती जर कमकुवत असेल तर मग सर्वच भरकटत जाईल यात शंका नाही. प्रथम जग लोकशाही व्यवस्थेकडे गेले तरच समस्या सुटण्याचा मार्ग दिसून येतो. अन्यथा इतर व्यवस्थांमुळे निष्पत्ती काय होईल हे कोणीही सांगू शकणार नाही. उत्तर कोरिया हे एक त्याचे उदाहरण.

जर आपण लोकशाहीबाबत जगाचा मागवा घेतला तर एक बाब लक्षात येईल की’ लोकशाही दिवसेंदिवस क्षीण होण्याची प्रक्रिया आता वाढतच चालली आहे. आपण जर जागतिक लोकशाहीच्या आरोग्याचे सिंहावलोकन केले तर परिस्थिती विचलित करणारी आहे. लोकशाहीचे मूल्यमापन करणाऱ्या अनेक संस्था आहेत, त्यापैकी व्ही-डेम इन्स्टिट्यूट यांनी जागतिक पातळीवर जगात सर्वत्र लोकशाही मूल्यांची अधोगती होत असल्याचे त्यांच्या अभ्यासावरून अधोरेखित केले आहे. त्याप्रमाणे आंतरराष्ट्रीय द इकॉनॉमिक्स या लंडनस्थित प्रथितयश नियतकालिकाच्या एक प्रभाग इकॉनॉमिक्स इंटेलिजन्स युनिट यांनी 2006 पासून जागतिक लोकशाहीचे दरवर्षी मूल्यमापन करून लोकशाही सुदृढतेचा निर्देशांक अभ्यासपूर्ण प्रक्रियेतून जाहीर करीत आलेले आहेत. सन 2021 च्या त्यांच्या अभ्यासानुसार जगातील फक्त सहा 6.4% लोक हे पूर्ण लोकशाही व्यवस्थेत असून 39.3% लोकसंख्या दोषपूर्ण लोकशाही, तर 17.2% लोकसंख्या मिश्र लोकशाही व 37.1 लोकसंख्या ही हुकूमशाही व्यवस्थेमध्ये आजही वावरत आहे. अमेरिका व भारत हे दोषपूर्ण लोकशाही व्यवस्थेत असल्याचा त्या युनिटचा निष्कर्ष आहे. त्यांचे आणखीन एक निरीक्षण असेही आहे की, उत्तरोत्तर लोकशाही क्षीणतेकडे झुकू लागली आहे.

जगातील लोकशाही भक्कम करावयाची झाल्यास पृथ्वीवरील सर्वात मोठी लोकशाही म्हणून भारताने पुढाकार घेणे आवश्यक ठरते. यापूर्वी तत्कालीन दोन महासत्तांच्या कोल्डवॉरपासून दूर राहून नॉन अलाईन्ड मोहीम चालवताना लोकशाही संकल्पनेला बळकटी देण्याच्या प्रयत्नात त्या वेळेस भारत आघाडीवर होता. आता पुन्हा त्यापेक्षा जास्त व्यापक भूमिका घेणे भारतासाठी आवश्यक आहे. अर्थात लोकशाहीची एकंदरीत घसरण थांबवण्यासाठी भारताने प्रथम स्वतःपासून सुरुवात केली पाहिजे. त्याबाबत काय करावे लागेल यावर अनेक मते-मतांतरे असू शकतील; पण मला जे वाटते ते पुढे नमूद करीत आहे. राज्यात जे सत्तांतरणाचे नाट्य सुरू आहे ते म्हणजे राज्यात शासन स्थापण्याकरिता ज्या समूहाकडे एकूण विधानसभेच्या आमदारांच्या संख्येपैकी निम्म्यापेक्षा जास्त म्हणजेच ज्यांच्याकडे बहुमत असेल ते घटनेप्रमाणे सक्षम ठरतात. अर्थात यामध्ये ‘समूह’ हा जो शब्द वापरण्यात आला आहे तो एक पक्ष किंवा अनेक पक्षांनी एकत्रित येऊन स्थापन केलेला समूह किंवा संख्याबळासाठी या दोन्ही प्रकारांतील समूहांनी अपक्ष म्हणून निवडून आलेल्या सदस्यांसहित सर्व सदस्यांचा संच असा होय. दुसऱ्या शब्दांत, पक्षांतरबंदी कायदा किंवा घटनेतील परिशिष्ट 10 मध्ये जे पक्षांतरबंदीच्या तरतुदींचा भंग केला नाही असे कोणीही सदस्यांचा संच एकत्र येऊन निम्म्यापेक्षा जास्त संख्याबळ जमू शकेल त्यांना शासन स्थापण्याची संधी प्राप्त होते. उदाहरण म्हणून महाराष्ट्राचा विचार केला तर विधानसभेचे एकूण संख्याबळ 288 असल्याने त्यांच्या निम्मे म्हणजे 144 पेक्षा जास्त संख्या ज्या समूहाकडे असेल ते सत्ता स्थापनेचा दावा करू शकतात, त्याप्रमाणे राज्यात आणि देशपातळीवर त्यांच्याकडे बहुमत म्हणजे एकूण विधानसभा सदस्य किंवा लोकसभा सदस्यसंख्येच्या निम्म्यापेक्षा जास्त सदस्य असतील त्यांचे शासन असते, हे घटनात्मक तरतूद म्हणून ठीक आहे. पण येथेच मग सुरुवातीला नमूद केल्याप्रमाणे सदस्यांचा किंवा पक्षाचा स्वार्थ हा सत्तास्थापनेसाठी महत्त्वाचा किंबहुना एकमेव धागा उरतो. यामध्ये लोकशाही मूल्य गौण ठरतात. या पार्श्वभूमीवर देशात लोकशाही बळकट होऊन त्याचे जगापुढे उत्तम उदाहरण ठेवायचे असेल तर काही मूलभूत बदल करणे अत्यावश्यक राहील. ते मी थोडक्यात मांडतो.

प्रथमतः लोकप्रतिनिधी निवडणे ही मतदारांची इच्छा असते, राजकीय पक्ष त्यामध्ये त्यामानाने लोकशाही मूल्यात व संविधानाच्या संरचनेप्रमाणे गौण असतो. खरे तर संविधान लागू झाल्यापासून सुरुवातीची 45 वर्षे ‘राजकीय पक्ष’ ही संकल्पना संविधानात 1985 मध्ये दहावे परिशिष्ट अंतर्भूत करण्यापर्यंत नव्हती. तथापि, राजकीय पक्षांमध्ये लोकशाही मूल्ये पायदळी तडवून ‘आयाराम गयाराम’ची संस्कृती निर्माण झाली. त्यावर दहावे परिशिष्ट रामबाण उपाय म्हणून अंतर्भूत करण्यात आले. एक चांगली सुरुवात झाली. त्याचे परिणाम चांगले दिसून आले असले तरी तो रामबाण उपाय नव्हताच, हे आता निर्विवादपणे स्पष्ट झाले आहे. जर यावर कायमस्वरूपी तोडगा काढावयाचा असेल तर निवडणुकीत पंजीकृत पक्षाने ज्या उमेदवाराला एबी फॉर्म दिला आहे तो उमेदवार निवडून आला तर तो त्याचा कार्यकाल संपेपर्यंत किंवा त्या पक्षाने त्याचे सदस्यत्व रद्द केले नाही तोपर्यंत तो एबी फॉर्म दिलेल्या पक्षातच असेल, अशी तरतूद संविधानात करण्यात यावी. याबाबत त्यांचे सदस्यत्व रद्द केले किंवा नाही, याचा निर्णय पक्षांतर्गत निवडणूक पद्धतीने निवडून आलेल्या पक्षप्रमुखांच्या स्वाक्षरीनेच ठरविण्याची ही तरतूद असावी. ज्या पक्षाने एबी फॉर्म दिलेला आहे त्या पक्षप्रमुखाने विधानसभाध्यक्ष किंवा लोकसभाध्यक्ष यांना कळवले की, त्या सदस्याने पक्षविरोधी भूमिका घेतली आहे ते लिखित कळविले तर त्याची पोच हीच त्या सदस्यांची सदस्यत्व रद्द होण्याची अंतिम प्रक्रिया असावी.

दुसरे म्हणजे प्रातिनिधिक लोकशाहीच्या सुदृढतेकरिता आणखी एक कलम संविधानात अंतर्भूत करणे गरजेचे आहे. विधानमंडळ किंवा संसदेत अविश्वासाचा किंवा विश्वासदर्शक प्रस्ताव काळात लोकप्रतिनिधींना त्यांची मते मांडण्याची पक्षविरहित मुभा असावी. दुसऱ्या शब्दांत व्हीप नावाचा प्रकार केवळ अविश्वास/विश्वासदर्शक प्रस्तावावरच असावा आणि अन्य बाबतींत सदस्याने पक्षविरोधी मत नोंदविले तरी ते सदस्य अपात्र ठरणार नाहीत म्हणजेच ते पक्षाचा नव्हे तर लोकभावनांचा आदर ठेवू शकतील.

तिसरी बाब म्हणजे, देशाने संपूर्ण लोकशाहीकडे वाटचाल करण्याकरिता पक्षांकडून पक्षाने निवडणुकीपूर्वी जे जाहीरनामे प्रसिद्ध होतात त्यास वैधानिक दर्जा देणे गरजेचे आहे. संविधानातील प्रकरण चारमधील निर्देशक तत्त्वाप्रमाणे देश चालावा, असे अभिप्रेत आहे. ते समोर ठेवून जाहीरनाम्याचा एक वैधानिक स्वरूप (फॉरमॅट) ठरविण्यात येऊन प्रत्येक पक्ष सेवा करण्यासाठी निवडून आला तर (सत्तेत नव्हे) काय करेल, याचा संपूर्ण लेखाजोखा व त्याची अंमलबजावणी करण्याचे, पाच वर्षांच्या मर्यादेचे वेळापत्रक देण्याचे बंधन करण्यात यावे; तसेच त्यासाठी निधीची आवश्यकता असेल तर तो कसा उभारला जाईल, यांचेही ढोबळमानाने धोरण देण्यात यावे. या जाहीरनाम्याव्यतिरिक्त मोठे धोरणात्मक निर्णय घ्यायचे असतील तर त्यास संसद वा विधानमंडळाचे दोनतृतीयांश बहुमत असल्याशिवाय घेण्यात येऊन नयेत, अशी तरतूद असावी. अर्थात, कोणते मोठे धोरणात्मक निर्णय आहेत हे ठरवणे अत्यंत क्लिष्ट भाग असल्याने त्यावर देशांतर्गत चर्चा होऊन यावर यथावकाश निर्णय व्हावा.

चौथी बाब म्हणजे देशातील भ्रष्टाचार निपटून काढावयाचा असेल तर लोकपाल, लाचलुचपत प्रतिबंध इत्यादी पोस्टमार्टेम अथवा घटना घडून गेल्यानंतरच्या उपाययोजनांबरोबरच मुळात भ्रष्टाचाराची जननी म्हणजे निवडणूक खर्च यावर पूर्णपणे मर्यादा आणावी. लोकशाहीच्या अनेक व्याख्यांपैकी ग्रीक तत्त्ववेत्त्यांनी केलेली व्याख्या म्हणजे दीन दुबळे आणि जे बहुमतात आहेत अशांचे शासन, अर्थात दीन दुबळे हे नेहमीच बहुमतात असतात. पण अलीकडील निवडणुकांचे खर्च पाहिले तर लोकशाही ही केवळ मूठभर श्रीमंतांची बटीक झाली आहे व लोकशाहीचे स्वरूप हे ‘श्रीमंतशाही’कडे झुकलेले आहे. जर भारतास आणि जगास खरोखरच निकोप लोकशाही पाहिजे असेल तर जे आर्थिक व सामाजिकदृष्ट्या क्षीण आहेत त्यांचा सहभाग हा त्यांच्या संख्येच्या सापेक्ष व्हायचा असेल तर निवडणुकांसाठी अजिबात खर्च होऊ नये, ही प्राथमिक गरज आहे. त्याच वेळेस निवडणुकादरम्यान खर्च केलेला पैसा पुन्हा राजकारणातून वसूल करणे किंवा इतर धनदांड्यांकडून देणगी स्वरूपातील मिळालेल्या मिळालेल्या पैशाच्या बदल्यात त्यांना धार्जिणे असलेले निर्णय घेण्याची बांधिलकी येणे व त्यामुळे  सर्वदूर भ्रष्टाचाराचा उगम होतो. हे सर्व टाळावयाचे असेल तर निधीचा निवडणुकीदरम्यान खर्चास मज्जाव हा एकमेव जालीम उपाय आहे.

वरील चार संविधानिक तरतुदींबरोबरच लोकशाहीमध्ये, ज्या लोकशाहीशी सुसंगत नाहीत अशा बाबी पूर्णपणे काढणे. याचा आढावा घेण्यासाठी देशभर जनमानसातून मते मागून विचार व्हावा. अशाच एका लोकशाही तत्त्वांच्या विरोधात संविधानात असलेली तरतूद म्हणजे राज्यपाल हे पद! लोकशाही ही जनतेच्या लोकप्रतिनिधीमार्फत चालवली जाते व तोच अशा शासनव्यवस्थेचा मूळ गाभा आहे. शिवाय या लोकप्रतिनिधींना सहाय्यभूत ठरेल अशी नोकरशाहीदेखील लोकशाहीला पूरक ठरावी म्हणून ती निकोप असावी असे तत्त्व अंतर्भूत असते. आपल्या संविधानाचा परामर्श घेतला तर राष्ट्रपतींपासून ग्रामपंचायत किंवा नगरपालिकांच्या संस्थांपर्यंत निवडणूक प्रक्रियेतून, मग तो प्रत्यक्षात निवडणूक असेल किंवा अप्रत्यक्ष असेल, लोकप्रतिनिधी निवडले जातात व तीच शासनव्यवस्था होय. नोकरशाही ही लोकशाहीला पूरक असावी म्हणून शिवाय ती तटस्थ असावी यासाठी संविधानातील प्रकरण 14 नुसार नोकरशाहीचा नियुक्त्या किंवा त्यांना सेवेतून काढून टाकणे याची एक तटस्थ व राजकारणविरहित व्यवस्था निर्माण केलेली आहे व त्यानुसार संघ व राज्य लोकसेवा आयोग आणि अन्य स्वतंत्र यंत्रणा निर्माण करण्याची तरतूद आहे जेणेकरून नोकरशाही राजकीय दबावापलीकडे राहू शकेल.

या सर्व लोकशाही व्यवस्थेत राज्यपाल असे एक पद आहे की जे ना लोकशाही प्रक्रियेच्या निवडणुका माध्यमातून येते अथवा तटस्थ यंत्रणेकडून निवडले जाते. राज्यपालाची नियुक्ती किंवा त्या पदावरील व्यक्तीला हटवणे, ही पूर्णपणे लोकशाही विसंगत राजकीय प्रक्रिया आहे. त्यामुळे हे पद लोकशाही संकल्पनेत अजिबात अंतर्भूत होत नाही. अशा लोकशाही प्रक्रियेच्या परिघाबाहेरील पद राज्याचा प्रमुख करणे, ही बाब लोकशाहीमध्ये हास्यास्पद आहे. हे पद संविधानिक बदल करून तातडीने रद्द केले पाहिजे. अर्थात, या पदाकडे जी कर्तव्ये सोपविलेली आहेत, त्यांसाठी स्वतंत्र लोकशाही व्यवस्था अपेक्षित आहे. एक तर राज्याचे प्रमुख हे लोकशाही प्रक्रियेतून आलेले मुख्यमंत्री हेच ठरविता येतील. दुसरे म्हणजे शिक्षण क्षेत्रातील कुलगुरूंच्या नेमणुका किंवा तत्सम कामे लोकशाही प्रक्रियेतून आलेले मंत्रिमंडळ हाताळू शकेल. अन्य अत्यंत महत्त्वाची सर्व कामे मंत्रिमंडळाकडे असताना या अशा किरकोळ बाबी अनभिषिक्त अशा पदाकडे ठेवण्याचे काहीच प्रयोजन नाही. मंत्रिमंडळाला शपथ देणे यासाठी राज्याच्या उच्च न्यायालयाचे मुख्य न्यायमूर्ती असू शकतात, त्यासाठी राज्यपालांची आवश्यकता नाही. अर्थात हा देश फेडरल पद्धतीने संरचित केलेला असल्याने केंद्र आणि राज्यांमध्ये दुवा ठेवणे आवश्यक आहे. त्याकरिता राज्यपालाऐवजी प्रत्येक राज्यात सध्या राज्यपालाचे सचिवालय असते ते राष्ट्रपतींचे सचिवालय म्हणून घोषित करता येऊ शकेल. यामध्ये सर्व राज्यांसाठी राष्ट्रपती हेच संविधानांतर्गत फेडरल संकल्पना मूर्त स्वरूपात राबू शकतील. तसेही राष्ट्रपतींच्या निवडणुकीमध्ये सर्व राज्यांचे विधानसभा सदस्य हे मतदार असल्याने ते लोकशाही प्रक्रियेतून आलेले पदच महत्त्वाच्या बाबी हाताळू शकेल. राज्यातील राष्ट्रपती सचिवालय दैनंदिनरीत्या राष्ट्रपती भवनाबरोबर संपर्कात राहू शकते. अशाने राज्यांच्या बाबतीत देशात कोणताही निर्णय व्हायचा असेल तर त्यामध्ये राज्या-राज्यांत वेगवेगळ्या राज्यपालांच्या लहरीप्रमाणे न राहता एकसमान व्यवस्था निर्माण होऊन देशाचे बळकटीकरण होण्यास मदत होईल व देशात लोकशाही व्यवस्था आणखी सुदृढ होऊ शकेल. राज्यपाल किंवा राजभवनांवर जो भरमसाट खर्च होतो तोदेखील त्यामधून कमी होऊ शकेल.

एकंदरीतच देशाची लोकशाही आणि तीदेखील जगातील सर्वांत मोठी लोकशाही निकोप करावयाची असेल तर वरीलप्रमाणे सांविधानिक बदल होणे गरजेचे आहे.

आज आंतरराष्ट्रीय फार्मासिस्ट दिन आहे. या दिनानिमित्त एक बाब देशातील सर्व रुग्णांनि आणि त्यांच्या नातेवाईकांनी लक्षात घेणे आवश्यक आहे.मी 2011 मध्ये ज्यावेळेस आयुक्त अन्न व प्रशासन म्हणून रुजू झालो त्यावेळेस ज्या गोष्टी निदर्शनास आल्या त्या नमूद करीत आहे.
औषधांच्या दुकानात फार्मासिस्ट असणे कायद्याने बंधनकारक करण्यात आलेले आहे. शिवाय सदर फार्मासिस्ट तेथे कोण आहे ते रुग्णांना समजावे म्हणून सकृतदर्शनी फार्मासिस्टच्या फोटोसहित त्याचे फार्मासिस्ट असण्याबाबतचे सर्टिफिकेट ठेवणे बंधनकारक आहे. हे यासाठी की जे औषध डॉक्टर देतात ते औषध सदर रुग्णाला योग्य आहे किंवा नाही, त्याची मात्र योग्य आहे किंवा नाही, त्यासाठी ते किती दिवस घ्यायचे तो कालावधी नमूद केला आहे तो योग्य आहे किंवा नाही, रुग्णांचे वजन वय या सापेक्षतेत आहे किंवा नाही, या औषधाचे दुष्परिणाम काय असतात, ते औषध कधी आणि कसे घ्यायचे इ बाबतचा सल्ला फार्मासिस्ट यांनी रुग्णांना द्यावयाचा असतो. जर औषध चुकीचे असेल किंवा चुकीच्या पद्धतीने घेतले तर ते रुग्णाच्या जीवावर बेतू शकते किंवा कालांतराने त्याचे दुष्परिणाम जे होऊ शकतात ते रुग्णास समजणे कठीण असते. त्यामुळे यासाठी फार्मसीचा सल्ला घेण्याबाबत जगभर कायदे असून तसाच कायदा भारतामध्येही आहे. दुसरे असे की फार्मसी च्या स्वाक्षरीनेच प्रेस्क्रीप्शन औषधे विकण्याचे बंधनकारक केलेले आहे.तिसरे असे की बिलाशिवाय औषधे विक्री करू नये असा कायदा असून त्या बिलावर फार्मासिस्टची स्वाक्षरी असणे बंधनकारक आहे. हे करण्याचे कारण म्हणजे रुग्णाला जरी डॉक्टरांनी औषध घेऊन दिले असले तरी फार्मसीस्टचा सल्ला आणि जे औषधे विकले जातात ते कंपन्यांनीच निर्माण केलेली आहेत किंवा ते बनावट आहेत हे समजण्यासाठी फार्मासिस्टची स्वाक्षरी ही बंधनकारक केलेली आहे. आपण कधी औषधांच्या दुकानात गेला असाल तर तेथे आपणास फार्मासिस्ट कधी दिसला आहे का?
मी ज्यावेळेस 2011 मध्ये आयुक्त, अन्न व औषध प्रशासन म्हणून काम पाहण्यास सुरुवात केली त्यावेळेस एक बाब निदर्शनास आले की बहुतांश दुकानात फार्मासिस्ट नव्हतेच, त्यांचे केवळ सर्टिफिकेट सकृत दर्शन टांगलेले असायचे. सदर सर्टिफिकेट हे रुपये पाचशे रुपया पासून पंधराशे पर्यंत भाड्याने, होय भाड्यानेच दुकानदाराने घेतलेले असायचे आणि संबंधित फार्मासिस्ट हा इतरत्र काम करायचा किंवा तो बेरोजगार असायचा. मी यामध्ये कायद्याने बंधनकारक केल्याप्रमाणे फार्मासिस्ट असण्याबाबत कडक धोरण स्वीकारले आणि त्याचे परिणाम चांगले झाले.(अर्थात औषध विक्रेत्या संगठना यांना ते न आवडल्याने त्यांनी माझी बदली करण्यासाठी तीन राज्यव्यापी संप केले.) त्याचा एक परिणाम म्हणजे रुग्णांना जी सेवा कायद्यात अपेक्षित आहे ती मिळू लागली; दुसरे म्हणजे फार्मासिस्टचा रोजगार वाढून त्यांच्या पगारांमध्ये घसघशीत वाढ झाली. एक काळ असा होता की फार्मसीचा तुटवडा सुद्धा जाणू लागला होता. त्याचे दृश्य स्वरूपात परिणाम म्हणजे फार्मासिस्ट महाविद्यालयांतील प्रवेशांमध्ये पूर्वी ज्या सीट्स रिक्त राहत होत्या त्या मी आयुक्त म्हणून रुजू झाल्यानंतर पूर्ण भरल्या जाऊन त्यावेळेस फार्मासिस्टच्या महाविद्यालयात प्रवेश घेण्यासाठी मोठी स्पर्धा निर्माण झाली होती. काल मी याबाबत माहिती घेतली असता असे दिसते की आता पुन्हा या महाविद्यालयामध्ये बऱ्याचशा सीट्स रिक्त राहत आहेत. याचाच अर्थ औषधांच्या दुकानात फार्मसीस्टची मागणी पूर्वीप्रमाणे राहिलेली नाही. याचे गंभीर परिणाम हे देशातील रुग्णाच्या आरोग्यावर होऊन त्याचे समाजावर मोठे विपरीत परिणाम होऊ शकतात.
याकरिता आपण सर्वांनी स्वतःच्या आणि कुटुंबियांच्या आरोग्यासाठी काही गोष्टी ज्या कायद्याने आपणास दिलेल्या आहेत त्या पाळूयात:
“1. औषधांच्या दुकानात गेल्यानंतर तेथे फार्मासिस्ट असेल तरच औषधे घ्यावीत अन्यथा त्या दुकानातून औषधे खरेदी करू नये.

  1. दुसरे औषधे घेतल्यानंतर त्यासाठी बिल मागावे आणि त्या बिलावर फार्मासिस्ट ची स्वाक्षरी आहे याची खात्री करावी.
  2. आणि तिसरी आणि सर्वात महत्त्वाची गोष्ट म्हणजे जे औषधे डॉक्टरांनी लिहून दिलेली आहेत ती कशी घ्यायची कधी घ्यायची किती घ्यायची त्याचे दुष्परिणाम काय याबाबतचा सल्ला घ्यावा कारण त्यासाठी त्यांना जो पगार मिळतो तो खर्च हा औषधांच्या किमतीमध्ये अंतर्भूत असतो हे लक्षात घ्यावे त्यामुळे यापुढे ही काळजी बाळगावी.
  3. ऑनलाइन औषधांची खरेदी करू नये ते आपल्या जीवावर बेतू शकते. ग्राहकांनो जागे व्हा, कायद्याने आपल्याला जे दिले आहे त्याचा वापर करा, अन्यथा एक निरक्षर देश म्हणूनच जगायचे की काय असा प्रश्न कायमस्वरूपी उभा राहील!

प्रशासकिय कार्यक्षमतेवर “अनुभवी” सल्ला!

फार फार वर्षांपूर्वीची गोष्ट. एक आटपाट नगर होतं. त्या नगराचा कारभार बघण्यासाठी राजा आणि त्याचे अष्टप्रधान मंडळ होते. राजाने घेतलेले निर्णय राबविण्यासाठी अत्यंत प्रगल्भ सचिव कायमस्वरूपी नेमलेले होते. निर्णय घेणे आणि ते राबविणे यासाठी फाईल नावाच्या कागदपत्राचा जन्म झाला, असेहि काही किरकोळ इतिहासकार सांगतात. राजाने फर्मान काढले कि सर्व सचिवांनी सर्व फाईल्सचा निपटारा त्याच दिवशी करावा; म्हणजे सायंकाळी घरी जातांना टेबलावर एकही फाईल शिल्लक राहू नये. ( फाईलला “नस्ती” म्हणण्याचेही फर्मान निघाले. …. “नस्ती” हेच नाव का ठेवले ते कोणालाच माहित नव्हते. काही उपदव्यापी लोकांनि आवई उठवली कि नस्ती उठाठेव, नस्ती ब्याद , नस्त्या उचापती इ मधून नस्तीचा उगम झाला. असो ….आपल्याला काय त्याचे!)

नगराच्या अनेक सचिवांपैकी एक सचिव इतके अलौकिक कार्यक्षम होते कि त्यांना राजाचे फर्मान यःकश्चित वाटत असावे. त्यांच्या टेबलावर इतका मोठा फायलींचा ढिगारा असायचा कि ते खुर्चीवर बसलेले असतांना समोरच्या व्यक्तीला ते दिसायचेच नाहीत. त्यांची कामाची पद्धत इतकी वेगवान होती कि बुलेट ट्रेनला लाजवेल! उप किंवा दुय्यम अधिकाऱ्याला जर एखाद्या फाईलवर त्यांच्याकडून निर्णय पाहिजे असेल तर त्याने स्वतः जाऊन ती फाईल त्या ढिगाऱ्यामधून शोधून ती सचिवांपुढे ठेवणे हाच पर्याय होता.

“फाईलवर सही आवश्यक आहे” अशी विनंती त्या उप/दुय्य अधिकाऱ्याने केल्यावर, ढिगाऱ्यापलीकडून त्या सचिवांचा खोल गेलेला आवाज यायचा “…आजही चाहिए क्या”? मग ती फाईल का सही करून(निर्णय म्हणणे जर जास्तच होईल!) पाहिजे यावर उप/दुय्यम अधिकाऱ्याला आर्जव करावे लागे आणि त्यात तो यशस्वी झाला तर ती पहिली लढाई जिकल्यासारखे होते कारण मग त्या ढिगाऱ्यातून नेमकी फाईल शोधून काढणे हि दुसरी लढाई!!

“…अरे, तुमहि फाईल इसमेसे ढुंडो और इधर लाओ”. अशी पडत्या फळाची आज्ञा झाली कि मग तो उप/दुय्यम अधिकारी त्याच्या आणखी एका दुय्यमला बोलवून त्या फाईलीचे ढिगाऱ्याखालून उत्खनन व्हायायचे. प्रयत्नाअंती फाईल शोध मोहिमेला यश यायचे. मग मग ती फाईल त्या कार्यक्षम सचिवांपुढे सहीकरिता ढिगाऱ्यापालिकडे जाऊन त्यांच्यासमोर टेबलावर जेमतेम फाईल मावेल इतक्या शिल्लक असलेल्या जागेत ठेवण्याचा आटापिटा होताच. गरज हि शोधाची जननी असते असे म्हणतात. तसेच कांहीतरी याबाबतीतहि झाले. सचिव केबिनमध्ये नसतांना फाईल शोधून काढून सर्वात वर दिसेल अशा पद्धतीने ठेवण्याची जबाबदारी अति-दुय्यमावर सोपविली जायची आणि ढिगाऱ्यातून फाईल शोधण्यातील वेळ वाचविला जायचा!

मग त्या फाईलमध्ये विषय काय आहे, निर्णय काय पाहिजे अशा फालतू फंदात न पडता किंवा फाईल वाचण्याची तसदी न घेताच ते सचिव अत्यंत कार्यक्षमपणे सही करायचे….आणि सही करतांना “प्रशासन कसे गतिमान आणि आधुनिक” झाले पाहिजे हे त्यांचे प्रगल्भ विचार मांडायचे.

नंतर ते निवृत्त झाले……

………..विशेष पुढेच आहे. निवृत्तीनंतर ते शांत बसले नाहीत! त्यांनी एका आटपाट नगराला “प्रशासन कार्यक्षम कसे करावे” याबाबत अधिकृतपणे सल्ला देऊ लागले.
